Deemed service

Stbx ignoring papers-

Said he would sign them never did. Sent him a text asking why he hasn’t signed and and he replied saying because of the lies I’ve told.

Would this be enough for deemed service?

It's risky. A Judge might not be satisfied with that.

I would get a process server to personally serve. Will cost about £120 but you can use the Certificate of Service to support you applications for decree nisi. Much quicker & easier in the long run.

Caveat - can only personally serve if it's a behaviour petition. If it's adultery or 2 years separation then you'd have to amend your petition.

I assume it's behaviour given he said about the "lies" Hmm

Thanks guys- wanted to avoid process server if possible- let’s jjst say he’s not being nice and this would aggravate him more :( I have messages where he’s said he is refusing to sign because of “my lies” then 5 mins later saying hes not refusing ! But nothing saying “I have them” although do have messages where we arranged to meet to discuss them - this is when he said he would sign
