I posted yesterday and strangely today I received Ex'es Form E via email from his solicitor. A couple of amendments to follow, namely a need to buy a new car with his savings and an increase to his salary.

The form isnt perfect and I'm going through it to exchange the next lot of paperwork by Wednesday which is the cut off date.

He states in Form E that he wants the property to be transferred into his name. I am the main carer for our 9, 8 and 5 year old boys. He is suffering with incurable cancer which suggests he only has 14 months in remission of, remission commenced in february this year.

He is pointing towards nesting (renting a flat and us going between whilst allowing the boys to remain in the home), which for me is just an option. He wants a clean break and nesting does not provide that. We have been living in the same house with the boys for 18 months and this just cannot carry on!!

I'm positive about the court hearing on 15th August although right now I've literally no idea which way this is likely to go!!!

Does anyone have any ideas/ words of support or wisdom?!!

A court isn't able to impose nesting on anyone, however neat a solution it might seem.

It's hard to suggest outcomes without knowing all the info, and more idea of the health issues, but it may be helpful to remember that the children's needs come first, even over poorly parents.

Is he likely to stay in work? Could he afford to rent on his salary? That seems a likelier outcome than uprooting all three kids to somewhere new (presumably rented).
