Divorce Nisi , Absolute and Financial settlement steps

My x has filed for Divorce and Nisi had been granted a few months ago. Now he seems to be quite and cooking something, might he is already involved with someone else.

What are the steps as Nisi has been granted

  1. As Nisi had been granted , should i just proceed with Absolute ?
  2. Should i apply for financial settlement after the Absolute ?
  3. Does it matter who apply for divorce will get some unfavorable choices during divorce / financial settlement ?

Get the financial settlement and consent order before decree absolute

The settlement to both parties is not impacted by who files nor who is ‘at fault’

Do you have a solicitor?

You need to get the financial clean break consent order before the absolute. Probably best to see a solicitor. The person that files for divorce applies for the absolute so if that was your husband you can't apply for it anyway.

Just in addition to this - the person that appies for the divorce must wait for 6 weeks and 1 day to pass before (s)he can apply for the Decree Absolute. If (s)he does not apply for it within three months after that period, then after that three month period YOU can apply for it. Hope that makes sense. Feel free to ask for clarification if not.
