So me and my lb dad got back together after we had been to court which he was given a access order of two times twice a week for four hours obviously this hasnt been stuck too as we were back in a relationship ! We broke up 3 weeks ago and he was due too have his access on saturday when my lb came home he told me he hadnt seen his dad and i later found out id been lied to over the four hour period as to where my lb was he was with his grandmother and she point blank lied to my face too my lb was very confused that he didnt see his dad and im very angry that i was lied too ! Can anyone tell me if this a breech of the court order as he wasnt in his fathers care when i was under the impression he was ???

How long were you back living together?

We didnt live together he mostly works away for weeks or months ! He hasnt had my lb on his own in that whole time.

OK, well that should mean the order remains in force. Resumption of cohabitation for 6 months invalidates a child arrangements order.

Their behaviour was wrong, however, it isn't a breach of the order that can be punished by the court.

Why is his contact so short? And do you actually have a problem with his mum, (beside the lying, of course)

His contact was supervised at first then went to that then after the last court hearing 18 months ago we ended up getting back together lb was 6 months old. He then worked away for the majority of last year and saw my lb maybe 5 times when he was home. Yeah i have had prior police involvement with his mother and i arnt happy that i was lied to as to where he was !

So if he lived with me for 6 months in the same house are you saying the court order becomes invalid ?
