Child benefit on separation

Quickie I hope. Can I claim child benefit after separating from my dh? We weren't before as he earned over £50k. We will be splitting having the kids 3/4 nights him/ me.
I've looked on Gov.uk and couldn't see an answer.

You could have claimed anyway before you separated, it's just he would have had to declare it and pay tax. So claim now and don't worry about it. If your not living together as a household i expect it won't affect his tax but if it does, is that your problem?

Thanks otherhalf. Dh is currently repaying the benefit and isn't happy for me to claim next year if that's the case after we've split as well as him paying maintenance, so I wanted to reassure him it would be different now.

So does anyone know if they still look at dhs income when I'm claiming child benefit when we're separated? Dh will have dcs 3 nights a week.

No, his tax position is only affected whilst you are together.

Thank you MrsBert
