Taking Ex to Court over Car

Ok I'm an idiot! I loaned my ex money to buy a car and he is now saying there was no verbal or written agreement to repay the money to me (he stated in front of his kids that he would start to pay me back for the car in the Jan 2012 after buying it in Aug 2011, so his kids know him to be a liar)

He sold the car 1 year after my buying it and he got another one, he's also emailed my solicitor to say it was a family car,

So my question is... now we have separated, will there be any chance of me taking him to small claims court to get back half the cost of the car? What are my chances of winning something back off the wanker?

Any advice welcomed please.

Are you separated or divorced ie have the assets of the marriage been formally split?

Separated and he is demanding £25k for split of house. I haven't agreed to that yet. I'm finding my solicitor isn't necessarily fighting my corner and I'm getting very frustrated over the dealings.

The vast majority of assets in a marriage are seen as belonging to you both, so I cannot see any chance of success for getting back a car you see as yours. It will go into the family pot with a value, if you are able to (well the one your husband has now, not the one from 2011). You add all the assets up, divide by 2, then the negotiations begin as to who might get more than 50%.

The only thing that has not been put in our joint pot is an account I set up to pay for the shortfall in DS1's 6th form bursary, which is made up from some inheritance (mine) and a gift from his Great Aunt.
