Can I get my husband out the house we both jointly own, I have 2 children my eldest isn't my husbands though ? he won't accept things are over but I just can't go on another second .

Could you move out? The fairest solution might be to sell up and start afresh.

My ex was advised to stay at the house until decree absolute and property transfer and very large money transfer from me to him and that took us 7 months (no court hearings) and a court sealed consent order to tie the money side up. Had he not left at that point i could have obtained a court order to remove him.

yes sadly soon to be ex husbands are adviced to stay in the family home until the diovce has ben finalized or they risk being totally shafted when it comes to dividing assits and or they are more likely to have a mesher order imposed.

My ex h wouldn't leave the house either and I tried to live with him for 6 months (while the house was for sale) but it was painfully difficult, I ended up doing all the chores as usual even though we weren't talking! I had to move out in the end to rented as I couldn't cope. Luckily we agreed a sale as I had to pay full rent and half mortgage.

I don't disagree though with the right of both parents to stay in their own home with their own children until things are resolved. Obviously if one wants to move out that's fine but it's a fair principle. I am sure most women wouldn't want to move out to a poky bed sit leaving their children behind whilst 2 years of slow divorce financial negotiations go on.
