Separation agreements?

DH and I have separated and he moved out last month. It's been a long time coming so I'm coping fine and focusing more on the practical side of things. My question is how does it work if we aim for the 2 year separation before going for a formal divorce, and use a separation agreement to draw up financial split and access arrangements for our DS? I'm a bit worried as I saw a solicitor today who said separation agreements are not legally binding so he could back out at any time especially on maintenance. We will be selling our house next spring and I want to ensure a fair split in my favour - DS only 3, I will be main carer and ex earns 3 x my salary - so would a separation agreement be sufficient? Bit confused by the whole process - can anyone share any advice? Thank you!

I don't really know but I would expect you come to an agreement between you and if he doesn't stick to it you then go a more formal route?
