I live in a house which is my partners / his mums with P and kids. I have been told i need to go for an occupancy order to stay in the house with the kids. I need to get everything sorted as he's a nightmare. Have any of you done this and do you wish you'd just moved out?

It's terribly complicated by the fact that his mother has an interest in the property. I don't think you'd get to stay in the property. An Occupation order is to be used when there's been domestic violence. Has there been any? This is a short term measure.

Longer term the court can allow you to live in his property with the kids until the kids leave school, but as in your case 3rd party rights would be affected I reckon you're not going to get anything there. If there's a lot of equity in the property perhaps consider a schedule 1 children act application asking the court to order him to buy another property. But that would depend upon him having the means to do so. Probably unlikely.
