Hi,

My husband and I have decided, very recently, to separate. We live in social housing, tenancy in joint names. i'm looking for advice on how this works. Who would keep the house/tenancy and would the other person be eligible to be re-housed? We have 2 dc and will be sharing custody 50/50.

ps. sorry if this is the wrong place for this post.

tia

I would assume that in your situation, it is up to you....usually it would be whoever has the children for most nights a week. As there are 7 in a week...one of you wll have 4 and the other 3? Unless you're rotating that? Do either of you work?

If one works close to your house then imo that person needs to keep the house.

Thanks for the reply.

I work full time close to the house, my h is stay at home dad following being made redundant a few years back. our custody arrangements will be split 4 night to 3 week one and alternate the next week, so no-one will be doing anymore.
I would rather leave to make a fresh start and the poor memories but not into temp accommodation or smaller property.

Contact your local housing office or housing association. Different councils/HAs may handle this situation differently depending on circumstance.
