Long story short. I am an involved Dad who see’s his child everyday of the week. Mother ended our relationship and moved 50km away. I work lates 2-10 or 3-11. I would bring or collect our child from nursery or do both. I only have one child and we have a wonderful bond. I have been in her life from birth until now aged 4. The mother has withheld the child since late November and I had a solicitor get involved to get her for Christmas. Then she went back to withholding and now in January I had to get my solicitor involved again to spend time with her. The mother also refuses to give me 3 nights a week. No safeguard reasonings offered to me or my solicitor or from hers. My question is how would this all look to a court. Especially considering I am a good dad and I enjoy being involved and doing day to day care. Can she just do this and force the court to her way? Even if that means cutting my contact out and trying to force me to me a EOW parent

I think you need to ensure you have all your evidence and demonstrate to a judge the benefits of your having your daughter three nights a week, and also making sure your time with her is formally confirmed.

I think it depends on what your ex’s side of the story is, her reasons for withholding contact and any evidence she has. If she has no evidence or any reason then I can’t see why a court won’t allow you contact.

She's doing it to try to force you to accept this as the new normal. Then she'll make a claim for Child Maintenance. Make sure you have all the evidence you need and fight her in court.

I would suggest going for primary custody. If she's done this twice already, a court order isn't going to stop her doing it again
