Hiya,

First time here but really need some advice.

I am currently transitioning from my current position to a new position with a new company.

This means from my current position I will only receive maybe less than 2 weeks worth of pay in October (around £700 after tax) and won’t get paid until the end of November from my new job which will include 6 weeks worth of salary.

I contacted CMS and stated due to my rent, bills etc and only having 700 pounds for the month next month I cannot afford to pay my ex partner for my children in October and asked if I could pay double in November with charges/fees on top if required.

They basically said no, if I don’t pay I will be taken to court and they don’t care about me moving jobs for a high salary. They don’t care I cannot afford to pay due to having to make sure my rent/bills/overheads are covered for the month as I need a roof over my head.

Is there anything I can do?

I cannot afford to pay and don’t want to take out a loan or similar as I offered in writing as well to pay double the next month.

Has CMS always been like this?

Yeah there's no real leeway. I think you can get a revision if theres a reduction in ongoing salary or something but i think thats a big change like 20 or 25%. Even then you wont necessarily get the change for the next month.
I think you have to pay it mate. Can you speak to your ex?

There's a forum called separated dad's. Id imagine if you post on there you are more likely to get a response that helps as traffic on this forum is slow and often female so you won't get much understanding.

Speak to your bank that you have your regular salary paid into. They may be able to give you an additional overdraft or a short term loan.

Alternatively speak to your new employer about relocation expenses. You might be surprised what they can pay and it'll be tax free too.

Do you not think that the mum uses the money to pay her bills so if you don't pay she won't have a roof over your kids head?

CMS dont work that quickly. If you are paying directly to your ex, then you skip a payment she can call them but they will take weeks to do anything. By the time they get the ball rolling, you will have already paid the missing amount.

It's a shit thing to do; you will have known about this for longer and could have spoken to your ex or saved up to cover the gap. Can your new enpkpuer not sub you?

Also, will you be getting a pay increase? I hope you'll be reporting that change and increasing your payments.
