Is the stay at home order actually law?

As per the title. Having a heated discussion at the moment. Is this the law or just advisory?

Since Parliament is not sitting, I don't see how Tier 4 etc. can be law.

I guess they will fudge some kind of process to make it into law tomorrow in business hours, else Monday.

As subordinate legislation (under the existing act) the regulations can be published without a vote or parliament sitting. But they have left it pretty late. If they intend to publish in the morning I feel very sorry for the lawyers drafting it overnight.

The only practical difference about exercise from last time is that we can't go out of our tier 4. When it was a national lockdown it was reasonable for my walk to go over the border (only 1/2 mile away) but (subject to the legislation actually saying this) it might not be. When we were in tier 3 (today, for one day only) it was guidance and not in the regs, so I hope it's the same for tier 4. Either way I'll still be aiming to walk / cycle in the quietest areas near me.

Thank you all.

I am devastated for what this means for my family.

But we have obeyed the rules since last March, and we will continue to do so now.

It's beyond frustrating that those who have never cared about the right thing to do will continue to do what they want, and have ruined it for everyone else.

That sounds more important than where you eat your Turkey.

If you explain your actual situation we might be able to help you. There are lots of exceptions depending on your situation.

Thanks Witches, it's nothing to do with where we eat our turkey, no.

We are in North London and were meant to be travelling to Ireland via Wales on Monday. Not even sure we will be allowed to board the ship at this stage.
There is a relative we will probably never see again as he is terminally ill and normally lives in Vancouver and will be returning home in January. I was just hoping to say my goodbyes in person.

We have been in strict isolation for 2 weeks in preparation and have taken private Covid tests.

I just don't know what to do really. I know it's not the end of the world but it's devastating for me personally.

It's a Stay At Home Order. It will be law either via Parliament or the covid emergency powers.

@Lurkingforawhile Yeah, I also feel sorry for the lawyers. It used to take 16 weeks to draft a fairly simple statutory instrument and the Word template was just bloody awful.

We are subject to countless regulations made by government department through the medium of statutory instruments under the legal authority of governing statutes. They are absolutely the law despite the absence of Parliament.

the updated guidance for tier4 is clear that you are allowed to leave home for funerals (and stay overnight) and to visit dying relatives .

If it were me I would still go ,while taking all precautions .

We were due to travel to Ireland via Wales also just after Christmas. Looks like that’ll be out of the question with Wales being in tier 4 & Ireland about to announce another lockdown. We have family over there too.
