Is it you should or “must” work from home?

My husband works for a small company, 10 of them in total.
During the last lockdown they worked from
home but all went back when the guidance on returning to work changed and was left up to the discretion of the employers.

The company introduced flexible working to include wfh days on a rotational basis.

When the guidance changed to wfh the company wanted to keep up with the rota and still have staff in office to keep up team morale and because it was better for business.

So this time, is it just work from home if you’re employer agrees, or is it you “must” work from home unless you can’t ie construction etc..?

The gov.uk website says something along the lines of if you can work effectively from home you must.

Although my job can technically be done from home, I found I really couldn't do it effectively last time - I felt very unmotivated, was lonely and miserable at home alone, and was regularly in tears. This time for the sake of my mental health I intend to ask to be able to work at least some days in the office (thankfully it won't close as it's a hospital).

If your DH can work effectively from home then the rules seem to say he must. If he can't, for whatever reason, he can go to work (assuming his workplace is open).

Yes he can work from home. So his employer doesn’t get the final say?
The rule is he must work from home
