Why not use up the 'sub-standard' Face Masks?

I know that Matt Hancock is in trouble with Boris because a batch of thousands of face masks were not up to standard for the NHS.
How about using them up for ordinary people to wear?
Or even hand them out as people get into a crowded Tube train?
Better than wasting them

Government give you a known ‘substandard’ face mask.
You get infected.
You sue the government.

Because they are substandard? We know that they are not up to nhs medical spec, but we don’t know how bad they are. A poor fitting, poor fabric etc face mask likely just to provide a false sense of security.
