Hi,
Can a nursery threaten with emails about paying for the whole next term within a certain amount of time, if we don't, they will contact my child's new school they won't send over the documents they need to send (developmental reports etc)? Long story short, we haven't had an agreement to pay the whole term upfront, it was a suggestion only, and why we need is bc we gave our notice too late so therefor we must pay (which we will but will do so monthly as we've alway done). They have also deleted the entire profile of my child from their app they're using, she's still going there and will do so until the end if this term, I cannot access anything anymore about my child's time there. It's very upsetting how aggressive they are. is this really ok to send emails like that?

Depends what’s in their policies/ agreements but it doesn’t sound good to be threatening. Why would they contact the new school? They can only do so if they have your permission to share info under GDPR rules so if they are threatening to tell them you owe money they are breaking confidentiality. If they are then saying they won’t send documents over they are contradicting themselves. They have a duty to provide you with any info they hold on your child (unless it is a serious safeguarding concern) so ask them for it and you can hand it over yourself. Not paying for next term should not affect any reports/ documents that they’ve already done. How have you paid termly before or are you suddenly being asked to pay a whole term upfront? Ofsted won’t get involved in contractual disputes but try contacting your LA early years team, they might be able to advise you, especially if you have been using funded hours.

Is it an independent school ? If so they may be asked to confirm no fees are outstanding, There is no obligation to send reports etc on though.

The monthly payment exists for people who are still with the nursery. You sound like you have decided to leave without notice which will incur fees. They don't have to give you credit for what you owe them!
