Nanny, maternity leave and end of contract - question

A few weeks ago we spoke to our nanny and agreed we would no longer employ her from September time, as my younger child would be going to preschool and after our discussion it became clear it wouldn't work her looking after the children only a few hours a day. We didn't agree an exact end date though or put anything in writing, thinking we'd confirm it all closer to the time (I think she is on two months' notice).

This week our nanny has told us she is pregnant and will probably be going on maternity leave in early July. Of course we will be paying her maternity leave.

I'm not sure how we handle the end of her employment given she'll be on mat leave, do we pay her holiday accruement until the end of her employment date or until the end of her mat leave, is there anything else we need to bear in mind? Are we still OK to terminate her employment as discussed? I can't seem to find any info online and don't want to leave her or us vulnerable.

Discuss redundancy procedure with your payroll provider. Given that you have verbally told your nanny already that the role is redundant in September I am unsure of where that puts things legally.

You are right to be thinking about holiday entitlement... if the role is made redundant before the end of maternity leave, then holiday entitlement builds up till the point of redundancy. If the role is redundant at the end of maternity leave, then holiday will have built up for a longer period of time. However the role is redundant, when it is redundant, which sounds like it is likely to be sometime in September.
