As to whether there are repercussions, the answer is yes: it is a criminal offence to employ someone who does not have permission to reside in the UK.

As to whether I would shop someone, the answer is no. Never.

As to whether I would continue with them in my employment: maybe. I would get them and me some good legal advice before I made that decision and would certainly pay them severance pay.

The onus is on you to ensure that you've employed someone who is legal to work in the UK. I wouldn't shop her but I would end the relationship immediately.

Wouldn't you know whether they were here legally or not when you checked their visa/passport? In which case you would be responsible for illegally employing them.

I wouldn't shop anyone though.

I wouldn't dream of shopping her though! She's a young girl from Australia and is lovely, does a great job and the children adore her and she adores them.

Worried for the lady who employs her though, and disagree with the other ladies I have discussed this with who say she should be shopped Shock

How do you know she's here illegally? I'd thought Australians could be in the UK for 2 years working; maybe it's changed?

I know a friend of the nanny who is here legally. I guess she told me because she knows I wouldn't turn her in.

The employer will know unless they failed to check her status
They may not care esp if they are paying cash only with no NI/tax deductions

I wouldn't shop her. But then my parents employed an illegal nanny who became a dear part of the family.

how can the employer not know she is here illegally ? Hmm They should have had a copy of her passport and visa if she is from outside EU. if she comes to the notice of the authorities they could report her and where will that leave employer and children ? She also has no employment rights and presumably is not paying NI or tax under PAYE which is employer's responsibility.
