Sorry imm it sure this is the right topic but couldn't see financial.

Cut a long story short, grandad recently passed away, he was in a care home for 3.5 years, my father (his son, only child) never had POA when grandad was alive so was unable to sell my grandad's flat to pay the care home fees. Now it has gone to probate, which is fine, but we have no idea how it works this is all new to us. The care home fees stand at £160,000, the flat is worth approx £140,000 and grandad had around £70,000 in the bank. So my question is, does the solicitor pay the care home straight from my grandad's account, emptying that but leaving around £90,000 to pay, but then my father must sell the flat within a time period to pay the £90,000 back within a specific time? I'm helping organize a funeral too and I think all the uncertainty is stressing him out along with grieving for my grandad I was just hoping to give him some answers if anyone can shed some light!

This is probably a question for the solicitor, I expect they have dealt with similar situations before, and will know what to do.

I'm surprised that with 70k in the bank, the care home haven't already taken some of that money ?

My dad is yet to see the solicitor all we know is that they are sorting out probate but he does need to talk to them but I think he's finding everything quite overwhelming and he's worried about it all.

Yes you would think but they weren't legally allowed to touch it either.

So my grandmas care home fees have an interest fee every month that the fees are outstanding. She died last month and we did probate ourselves which came through in 10 days. The house is in the process of being sold.

Also, do they have to leave u 23k in the will after paying the debts? This is what people have said but our solicitor said it isn't true.
