12 year old daughter being bullied

My daughter is 12 years old and has started high school. Her brother is in year 9 and when she started she would hang with him and his friends. However one of his friends had started to call my daughter a name that is not hers, this made her unhappy and she told him to shut up and he continued and we reported it to the school. The child didn't not listen and carried on and one day he called it again and my daughter replied with shut up spotty face, and his response to this was pushing her into a table and hurting her, the school was informed by her brother and others that was present and the situation seemed to be resolved, the school was effective in dealing with it quickly. However now my daughter is refusing to go to school as she no long feels safe being in the same school as this child. This child has also made up lies about her bother and his other friends. She stopped going to school just before the Christmas break and is refusing to attend. The school have offered that she can go to an area where she can play games or do work during lunchtimes, but why should my child be made to sit inside when she has done nothing wrong, she does not want to be in the same building as this child, she will not even go and pick her brother up from school incase she sees this child. We have put in an application to another school and are now awaiting a date for appeal.

I was wondering if anyone has ever been in this situation and what can I do? as my worry is yes I get her to school and through the gates but what is stopping her from walking back out and walking the streets all day, where as I know where she at home and she is safe if that make sense? She does do school subject on bitesize so she is doing some work.
