My disabled son is being bullied by higher staff in school. need a mumsnet army

My son has cerebral palsy and him and a group of others leaves class 5 minutes early to avoid the rush and they are trying take this ability off the group. they also have to go out of the class to do exams/tests and the higher ups are trying to stop this. they also leave the class if it's being too loud they are also trying to stop this. These requirements are in their EHCPs and are legal requirements. They are also trying to change the EHCPs without our consent

Hello. Reporting for duty. First thing to do is talk to the school senco, which I assume you have already done?
Ultimately the legal responsibility for providing the things named in the ehcp lies with the local council. If you let the Sen team at the council know there is an issue and give them the opportunity to respond (with a reasonable deadline)then you can threaten them with a "letter before action" which is a legal thing which lets them know you are pursuing legal action. You don't have to be a lawyer to send one. If this doesn't work then because it is your child and not you who is the claimant then you can get legal aid and take the council to a judicial review for not providing the care in the ehcp. Lots of info on the process on the ipsea website here www.ipsea.org.uk/complaining-when-the-provision-in-an-ehc-plan-is-not-being-made-model-letter-6 also you could contact the school gebenors and mention disability discrimination, which may speed things up too.

Most councils fold at the letter before action point.

Is he being stopped or just his group of friends? And if its his friends do they also have SEN?
