5yo hitting and biting at school

My 5yo has been in trouble in school (year r) for hitting and biting another pupil (a friend). It seems to have come to a head today. They definitely did do it but it’s become apparent that another child (another friend who is bright but often over eager) had told them to to do it and this has happened on multiple occasions. I’m concerned that my child is getting into trouble when another child is also planning and telling them to do it. The school are rightly taking this very seriously as it does seem that this is has happened multiple times. I’d welcome ideas about how we should handle this. The other child doesn’t seem to have been involved in any of the hitting but has been involved in the planning if you see what I mean. They are 5 so should definitely know better.
