Too sick to return after maternity leave

Hi

Hoping someone can help here although I'm not sure if this should be in legal or employement rights.
I'm supporting a young woman who has severe post natal illness and her Occuational Health team have said she can't return to work yet. The main problem with this is she won't receive anymore maternity pay which will create further problems for her. Does anyone know if she claim sick pay from her employer? She actually wants to return to work as she thinks it will help ( I won't go into the background ) but it's her employer's OH team that have said she can't. Any advice will be greatly appreciated

She needs to look at her sickness policy...no point asking on here....only she can provide you with this

I wondered if there were any special laws around maternity/sick leave

If she had submitted her date to return to work, with the appropriate notice, but her employer has decided she's not fit for work, then from the date she should return , she should be eligible for sick pay, be that company or ssp.

I would also look at ESA as an option.

Is the pnd likely to be under wider mh issues, if so it maybe worth looking into pip as well.
