to expect the council to house us even though DH is sshh ..... working!!

Landlord has a court order for possession which runs out tomorrow. Council have basically said we will have to wait for the court bailiffs to physically kick us out and then go to them with our stuff in binbags before they will provide us with anything even emergency housing which is quite a stressful thought . It could be that we have no more than 7 days until we get kicked out depending on how long it takes for the LL to arrange the bailiffs to come. Obviously I have no problem with the LL wanting us out and feel terrible that he has been forced to take us to court but it is the only way the council will help us.

BTW we are not feckless or scroungers! We have 4 DCs - youngest 2mnths old. DH works around 48 hours a week and has a relatively good wage. We are not entitled to tax credits (child benefit only) and have struggled with the massive amount we have to pay in private rent but scraped by without too much hassle. LL decided to sell house last year, we knew we would have problems renting again as we are both had to go bankrupt (1 year ago) since we moved into this house so our credit is shot and no chance of ever having a mortgage again . Current letting agents said they would not be able to rent to us again because of this as we have no one to be guarantor even though they have had no problems with us and nor will any other agent. There are no properties being advertised by individuals that would not need a credit check round here (except for shared house rooms) and anyway all 3 bed properties are like gold dust so we are in deep shit!!

The council keep telling us that as DH works we should find our own property. We keep telling them that we can't for reasons detailed above. It seems that if he was not working and we were on benefits, they would bend over backwards to help but as he is a taxpayer, they will not do anything. Is it me or is this a bit arse about face??

It goes on points. You are homeless - so you should get a lot of points. Now that doesn't mean you'll walk into a house! One may not be available. But you'll be higher up on the list.

Anyone is entitled to apply for council / HA housing, working or not. And the council are being very unfair to dismiss what you are saying - you should get a letter from your letting agent saying they will not help you because of the bankruptcy and take it to the council.

Morloth - the reason i said that i wasnt straight away was because someone has made a similar comment before, and she got flamed for being racist, but again i dont think thats what she meant. I get on with people from all races. Theres people down the road who were being racist at our african neighbours i thought it was disgusting, and yes i did go out and stick up for her, she is lovely.

My DP and I earn a combined salary of £43K and we would have big trouble raising 3 months deposit in 5 months. And we live very frugally too - no credit cards, old car, camping holidays, meal planning etc...

OP.
I am a landlord.

I am about to not only sue my previous tenant, but report them to the police for vandalism and theft, and I am also going to report them for benefits fraud.

Why?

I am feeling malevolent. I will be damned if I dont stitch THEM up as bad as they have stitched US up. Not only are they in arrears and owe us money (there is still a mortgage go pay even if THEY dont pay rent), we will have to pay thousands just to make the property habitable again. It will take months. Months of us not earning, with an empty property.

And references? Oh yes, the truth will be told.

MP - I thought the LL was serving the section 21 'cos he wants 'em out to sell the property - usually the advice is to let it go to court but still pay the rent during that time.

I didn't see the OP state that they were with holding rent - that would be a different kettle of fish.

I think that we need further clarification on that point.

But I can say with some certainty that neither CAB or Shelter would advise with holding rent.

qs...your experience (and a similar one of my SIL's) is why I ignored my DH when he tried to push for us to purchase buy-to-let property a few years ago

Saying that the housing stock is going to foreigners is a racist statement unless you can back it up with cold hard data to prove your point. Simply adding the words "I am not a racist" doesn't change the fact that what you said previously was.

You are words on a page, the words you have written are racist and the comments about bitchy women (implying that is why people were offended) are sexist.

It is the best thing about chatting via text, all the preconceptions about people are unavailable and you can be taken at your word. So you need to think carefully about the words you use if you don't wish to be misinterpreted.
