My sis was involved in an accident with a lorry last week. The lorry driver was at fault and my sister has highway agency staff at witnesses. The complication is that the lorry driver was european.
She does not have legal cover, however her insurance company are telling her that if they recover the claim from the lorry driver's insurance company, they will not get her excess back for her, she has to sue the driver seperately for that.
Surely the other insurance company should be paying her full claim not just what her insurance would pay out!
I can understand if they can't get the money from the other inusrance company then she will lose her excess.
