Marriage over since January, he sleeps in what was our guest room, have started mediation but he refuses to pay my share of equity or to move out himself or to sell the house. Won't consider paying a proportion of equity which he can easily afford, which I could then top up with a mortgage and get a place for me and the children. He knows I find this situation v stressful, it is horrible for all of us. He says court orders are worthless. House in his name only and he holds all the cards right now. I have had enough.

Have you been to a solicitor?

I have always been under the assumption that if a couples marriage breaks down then the husband moves out so the wife and children have somewhere to live.

Either way, I think you should go to a solicitor and find out were you stand.

I know where I stand, have done that, thanks - but no-one can make him give me what I am legally entitled to if he is determined not to. I am trapped.

Then if you are so unhappy you must leave.
I know this must sound terrifying but you obviously cant go on like this you will make yourself ill.

You need more advice from people who have been in this situation.
Maybe you can get in touch with CAB and explain your problem and see if they can help you get out of there.

What about his family or work colleagues. Have you approached them yourself to ask if they could take him or at the very least talk to him.
Do you have joint bank accounts?
