Someone reversed into my fence panel. What would you do?

On Saturday morning, a woman reversed into our fence. She lives out the back of us - don’t know her at all as we are in a very small cul de sac of 4 houses and she lives over the back where there are parking spaces outside of a few houses.

I didn’t realise she’d done it as it’s in our back garden - until she knocked on my door and told me. I’m grateful she was honest about it and commend her for doing so as we genuinely would have been so puzzled otherwise

She said she was on heavy duty antibiotics and had her two small children in the car and just misjudged. We went into the garden to see the damage - and yeah. She’s caved in the fence, torn it from the posts and it cannot be put back into place

I took her number, told her not to stress , thanked her for letting me know and advised I’d be in touch once I’d got a quote for the damage and we’d take it from there

A local fencing guy came out - we’ve used him on and off for years. The upshot is, it’s almost £400 to put right (we do not have basic fence panels .. I’ve no idea what they’re called but they’re grooved with horizontal posts across them)

I sent her over the quote and she messaged back to say she’s a single parent in social housing and she doesn’t know what to do

So. What do I do? Tell her to go through her insurance? I appreciate an excess payment can be a lot. Do we suck up the cost ourselves and ‘be kind?’ ( we can afford to do this if we have to BUT not easily on a whim and not without feeling it) or .. something else?

I suggested installments as it initially sounded like you were prepared to write off the costs and pay yourselves. It would have been a way of trying to deal with it in a pragmatic way. Nothing illegal or unprofessional about it.

A written agreement detailing livability and plan is easily drawn up. If she doesn’t pay you can then either do a money claim or just write it off.

I would ask if she wants to pay cash or go through the insurance. No reason for you to take any of the financial fall for this. I also agree that if you let her off the hook you’re likely to see her the following week packing her car up for a holiday!

@RosesAndHellebores we have 19 fence panels in total and replaced them all at huge cost 3 years ago. They were all repainted dark grey last summer.

and she probably told me because you never know who has cameras etc. we have two out the front and two at the back but not over where this particular fence is

Our excess is £500 and if it wasn't, a small claim would increase next year's premium.

How old was the fence panel? Do you regularly paint it?

I'd be minded to ask her for £100 and be done with it.

She won’t be paying an excess though unless she’s claiming for damage to her car.

OP, go through her insurance, that’s what it’s there for.

My husband reversed into another car earlier this year, it looked damage free but he still left a note with his details. unfortunately there was damage he missed and we opted to just go through insurance rather than piss around trying to settle cash

Nah, neighbour casued the damage and should be the one to put it right.

Yeah, she did the right thing and fessed up, is that not what we should all be expected to do though? Its morally the right thing to do and we shouldn't be so impressed that someone does that, we enable ourselves to be out of pocket.

I'd tell her she can get her own quote if she wants, but so far thats the price. Suggest she uses her car insurance if she doesn't have the cash op, but don't get drawn into guilt trips and sob stories. She caused the damage, yeah, its unfortunate and a pain but accidents happen and thats the reason we have car insurance, for instances where we accidentally cause damage

I was well off enough to spend £10000 on a new roof once. Doesn't mean I'm well off enough to fork out again if my neighbour damaged it

Having work done to your house once doesn't mean you can afford to pay out to have it done again and again.

She hasn't wrecked your property, she backed into a fence panel and owned up to it.

In my experience, having been very sympathetic and generous in the past, the people who 'can't afford it' that you let get away with things often turn up shortly afterwards with some sort of spending that means they could afford it, they just chose not to. I'm no longer a sucker.

In my experience, when I need help, people are much less sympathetic than I've tended to be.

I might be a slow learner but learn I did. She caused the damage, she finds a way to pay. She should have insurance for this.

You have nothing to feel bad about. She should feel bad as she was driving under the influence of medication. She's lucky all she has to do is pay for a fence panel.

Op, I understand where you are coming from but believe me, trying to sort out installments etc will turn out to add extra stress. Just be clear of the costs and if she cannot pay, tell her you will sort it out via her car insurance and then call your insurance company with her details.

This happened to us but the person drove off. Our doorbell camera caught the numberplate. Police found the person and got their car insurance details for us.

We dealt with their insurance company directly. Really easy. We got 3 quotes (£800 ish) for a new concrete post and fencing and their insurance company paid us the amount.

Maybe you could pay the $300 difference then. It is not the OPs fault or cost to bear.
If she should just pay it forwards and help out a single mum then maybe you could instead?
