Anyone know how I can get help with a disability and a Section 8 possession notice?

My disability affects my brain so i need help to defend my section 8.

I'm having no joy with Shelter or HPLAS.

I'm feeling rather desperate.

What grounds has the section 8 been served on?

The landlord must have provided a reason for serving the notice, is it that they want to sell or is it something you have done that they want you to leave?

Discretionary. Basically my children doing gymnastics in the living room in a flat which has no soundproofing and shakes the windows when you walk. Siblings fighting - shouting. 1 child has moved out and LL says other flat holders say there is no noise anymore. There isn't as there is only one child in the house.Tje problem is solved but they are trying to say the quiet may not be permanent. which is stupid.

stupid because it was siblings fights and there is only one child now so no siblings fights.

Your child is young enough to do gymnastics and fight with siblings and has now moved to Australia? Really?

You will need to get a solicitor but tbh I don't think you have grounds to challenge it. A disability doesn't give you the right to let your kids cause misery to your neighbours.

What support are your children getting if you struggle to parent them due to your disability?

Have you asked them to put their advice in writing so that you can take time to process it?

You could try the housing officer at the council for some support. I would say that if this is the whole story and you have a disability it would be fairly unlikely for the court to award possession. You may be subjected to a suspended possession order and if there are further complaints the court may then decide to award possession. There is no specific ground for noise so it would be helpful to find the exact ground they have served the notice on as that will be the basis of your defence. I don’t know if you’re involved with any charities with your disability but it may be worth speaking to some disability support charities as this is likely something they would be able to help you with in some capacity.

Some such charities have staff or trained volunteers who can help you and advocate for you.

I also second speaking to the council. If you have a disability, they may have a statutory duty to house you if you become homeless. They'd prefer to help you not to end up homeless, so should be able to give you advice and possibly help.

Some folk think social housing tenants are lucky. 😳 has anyone in the house any sensory issues it might excuse the bouncing/gymnastics.

Exactly what I thought, but even so no one should be doing gymnastics in a flat, especially one as badly soundproofed as the OP said. Sensory issues are no excuse despite Emerald Shamrock 000 suggesting otherwise.

Have you looked into local housing charities? A local law centre might provide no cost legal advice.
