I was a few days late submitting my Tax Return due to being in hospital last year and as result I was charged £100 late filing penalty.

AIBU to think that Angela Rayner should have to pay interest and penalties for underpayment of Stamp Duty. This makes me so fucking angry.

She was in a complicated divorce with a disabled child - it was a very complicated situation and not actually clear, she was given bad tax advice. HMRC have done what is fair. You however have an entire year to submit a tax return and MULTIPLE letters in that period. The tax return deadlines are the exact same every single year, and it’s a super simple process. What was your excuse?

I don’t really understand the point - if there is no wrongdoing why would she pay fines/ interest? They are mutually exclusive.

because it is the responsibility of the person paying the tax to make sure forms are completed correctly then for HRMC to then calculate how much tax is to be paid

there is clear deadlines to do this by it is not something that changes year to year. Tax is often complex that's why if needed you get advice and should follow advice

Being advised by your legal advisor to take tax advice and then failing to, is not receiving bad tax advice.
I don't know why posters keep repeating this lie that she got bad tax advice - she simply failed to get any tax advice despite being recommended to do so.

Angela Rayner should have waited until her son was 18 surely? Then he can legally own the property and the flat she purchased would not have constituted a second home.

As a politician, she should have sought tax advice and paid up or waited. Pretty much everyone knows that trust law is complex and as housing secretary she should educate herself on stamp duty and its impact on the housing market as well.

But deadlines weren’t missed, an error was made and it was found there was no wrong doing. You wouldn’t expect to be fined for a genuine mistake.

I do not think you understand the legal point of the trust structure for under 18s.

She could have rented and bought once he is 18 which is quite soon! Given the Renters Right Act protections etc - she could have put her money where her mouth it.

There is no message to parents of disabled children. If the trust means she is technically still the owner because her child is under 17, the rationale thing to do is to wait until he is 18 and rent. And then purchase as it does not constitute an additional property purchase.

So that is your message - divorced parents of disabled children should not expect to have their own home until the child is 18. You think they should rent and wait to have their own home or pay a bunch of extra tax.

As I said - this is an issue completely independent of politics. Its about the challenges for parents of disabled children, especially where a marriage breaks down (hardly rare in this situation).

On the tax situation - solicitors/accountants routinely slap in small print about “but speak to other expert” to cover themselves. She took the advice of two different sets of experts (trusts and property) - even HMRC has very few people more able to advise. in this situation.

As a cabinet minister should she have pulled rank and demanded HMRC time? Yes probably with hindsight, but the reality in this situation is that most people having two sets of expert advisors would not seek a third. And of course then the story would have been Rayner hijacks busy tax affairs for her personal tax advice - because that extra layer of expertise is thin on the ground, even in HMRC.

@C8H10N4O2 - Angela Rayner’s son is 17 and born in 2008 - same as one of my DC. Had she sought proper tax advice they would likely have told her to wait until he is 18!
Don’t shoot the messenger.
Same applies to anyone getting a divorce and trying to put the property in a trust for under 18s instead of sharing it between them. She could have also presumably put the money not in a property!

This is NOT about disabled children at all. It is about being a senior politician and seeking tax advice because that is the right thing to model to the general population. Namely that you follow the law, pay your taxes and do not take freebies etc or favours.

Yes I read a couple of reports that she paid no fines or penalties.
Extraordinary when you consider how HMRC treats mere mortals who make a simple error or file their return a day late.

We've got a problem going back 4 years, despite using an accountant. So far the fines are in the £000s. The issue doesn't even result in us paying any money! But they have taken till October last year to actually tell us what we allegedly hadn't done....it appears that their system cannot pick up once piece of info from the accountant system!!! They have even told him that...

Minor slip up by Kemi. She is clearly a very well articulated intelligent individual. She regularly wipes the floor with Starmer when she debates with him. Rayner by comparison has consistently demonstrated that she lacks any intellectual depth when she’s had to stand in for Starmer. She’s not pm material. Not even close to it. Kemi very definitely is.

IMe corporations are allowed to correct without fine regularly. I have done this many times in my career
