AIBU to stop chasing the gardener and pay for waste removal?

Hired a gardener to work on our large garden which was not in a good state. We agreed it would be a two day job. At the end of the first day he took several car loads of garden waste to the recycling centre. All fine.

On Day 2 he said the work was lot more than he first realised and I agreed to pay a bit more than initially agreed as it fairness I could see it was a lot of work.

End of Day 2 and he said the recycling centre was closed due to his late finish so he would be back at 10am today to take that day’s waste away. He was an extremely pleasant, hardworking man but I honesty had the feeling as he drove away that I would never see him again. I had paid in full via bank transfer as he was finishing up, before he told me he would have to return to get the waste. If I had retained some of the money he’d be back but I doubt it now he’s been fully paid.

Lo and behold today he messaged to say he would be over this afternoon instead of 10am and with a friend to help as he is unwell. No sign of him so far. Rather than chase I’m resigned to the fact he’s pulled a fast one and am looking up how much it would cost to get someone out to move the remaining waste. DP is fuming, both at the gardener but also my defeatist attitude.

I just don’t have the strength to get upset about it. I hate, hate, hate dealing with trades because they always do this. Behave unprofessionally and lie. I almost expected it. I can see the script, I will chase he will reply sporadically but never return. Why waste my time. I found him on a trade site where you can leave reviews but he only has 5* reviews so I suspect the site does not publish negative reviews as he has apparently been hired 130 times but there are only a dozen reviews, all glowing. AIBU to just cut my losses and find someone else rather than chase this person?

Give him some time. If it's still there this time next week then fair enough. I always clarify that waste removal is included in any garden quote. If he's taking it in his car and has underestimated the job it would seem that he's not experienced.

I would give it time too. Although saying he is 'unwell' is a common tactic, there is the 'very' slim chance he actually is. I'd message again in a day or so. Our electrician was part way through a job and was suddenly a no show. Turned out he was in hospital with a collapsed lung!

I have no idea why you paid him when the job wasn't complete? More the fool you! I would have paid that evening and only once the stuff was cleared away.

If after a week or so you get no response and and he hasn't sorted it, I'd add a review on the trade site but also on nextdoor.com in your area to warn others. Posts can always be removed if he did actually then turn up.

Yeah fair enough, my neighbour also thinks I’m being very impatient and should wait a week😭

I think I'd maybe give 48 hours, then make your own arrangements and give a bad review.

I think you're right that he's unlikely to be back. Lesson learnt to not pay until everything it done!

The job itself was complete and he was gathering the waste to put in his car. I know I should have held off transferring the money but I was on my way out and thought everything was basically done. Then, with the waste piled up, he told me the recycling centre had closed so he’d have to come back (I checked and it was indeed closed).

I’ve learned the hard way not to pay until it’s all done. If they’re desperate for the money give them most of it but keep back 25%. At least that way if they don’t show up you have them money to get the job finished. 25% should be enough of an incentive for them not to ditch it.

But this is so recent! Surely you're jumping to the conclusion he won't return? Give him a couple of days - I'd be texting and arranging a date/time though.

He should have taken the waste with him still to put in the tip the next morning! He for most likely got a notification that you had paid him in full so saw a nice easy end to his day!

I paid 25% at the end of day 1. The following day he called in sick with the same illness he is now claiming to have again. He then returned the following day with a relative to help him finish the work. It might all be genuine but as he has been paid in full now I’ve mentally accepted he’ll not be back and just want to call a waste management company in so we can get our garden back but DP is resisting.

I appreciate I was extremely foolish to make that final bank transfer. What is galling is he kept saying I was such a nice customer, he wished they were all like me. Yep, all as stupid and naive!

Just to update that he did come back! He claimed he fell off a ladder and had concussion which caused the delay. He called to tell me and left a voicemail saying he was “currently in A&E” but the background noise clearly sounded like he was in a pub or restaurant😂

He did a good job though and is now doing my neighbours garden.

Good! He may well have fell off the ladder (it’s happened to more than one workman I’ve had (with the cast to show off). Anyway job done!
