Credit rating in divorce proceedings

Currently going through divorce court.

I have found out that STBXH was in a lot of credit card debt from gambling and his failing business. He also lived hundreds on pounds in his overdraft each month.

I can see he’s sold assets and cleared his debt upon our separation.

But, will his credit rating be considered in proceedings given he’s unlikely to get a mortgage due to this?

Were the assets he sold likely to have been considered joint assets? Usually the ability to rehouse yourself is only considered the other person's issue if that person has gained. You won't be expected to get less because he's lost out while gambling.

It is a needs based case so the judge will want to see us both housed.

The assets sold were business assets that would, technically, form part of the joint pot.

I am assuming then he’ll just be told here’s £X, you’ll have to rent if you can’t get a mortgage?

That's were your legal advice comes in, because it depends on how big a pot we are taking about and what you can buy in your area. But under these circumstances, you wouldn't be left inadequately housed to make up for his gambling. If he's a recovering addict, it's probably best he rents tbh.
