Update on Sandra Peggie Case

It's been reported in the Scottish Herald today, that although the judge is allowing the bananarama defence to proceed, he has stated that the NHS team have 'acted negligently' . This is an extraordinary rebuke and it is very unusual for a judge to do this. I've had a google and this story has been covered in the Daily Mail (no paywall) and the Daily Telegraph (paywall). Nothing in the Times, Guardian or BBC as yet.

I thought that the judge wasn't allowing more time for the bananarama defence (It aint what you do, it's the way that you do it), because it is already implied. If that's what the defence have decided they want to focus on, then they have been negligent in not doing so from the beginning.

I thought they hadn't allowed it on the big main bit (as NHS Fife wanted to do) but they've allowed it on the smaller list of additional stuff.

The optimist in me hopes this is because when they totally anhiliate NHS Fife in court they can say "we did consider it, so you can't turn around and say waaahhh you didn't let us, and then use that to appeal"

That's my hope anyway, IANAL obviously, what with technical jargon like 'big main bit' in my summary 😂
