Should I tell Tesco I basically stole £300 from them?

Just checked my banking app and had around £300 more than I was expecting. Turns out that one of our shops was cancelled by dh but it still showed up for delivery. Husband wasn’t in so son accepted the order AND we got the refund. So it’s actually funny because our texts shows us getting our wires crossed. Husband thought I had unilaterally decided to reorder. He asked “so you did decide to do the shop in the end” and I answered in the affirmative as I very coincidentally happened to go into M and S for some bits my daughter wanted to try. And it was that I thought he was referring to. I thought her was being sexy cause dd went a bit overboard with the cookies, dips etc

Anyway, it’s been about three weeks. I guess this has slipped through.

Wouls you tell Tesco? I’m surprised that the idea of being sneaky flashed in my mind.

It was a pricier shop as DH ordered a few nicer bottles of wine to enjoy for a family event.

Can someone please tell me where on the scale of Small, Medium, Large, Huge International Corporation, organisations it is OK to benefit from by not letting them know they have delivered £300 worth of goods which you ordered but then cancelled and have now not paid for ?

The reason why I wouldn’t tell them is that you cancelled it. You shouldn’t have to pay for a shop that you cancelled. You can’t return the order now and they wouldn’t have taken the actual physical order back anyway. There actually isn’t a way to put this right that doesn’t leave you incorrectly out of pocket.

This. Why should you be out of pocket for their error? You cancelled it in time; they accepted that cancellation, so you technically shouldn't have to now pay for food you'd decided you didn't want.
If the food would be put to good use, eg, food bank donations then fine, I'd send it back, but it will simply be thrown away, which is so wasteful, so I wouldn't be able to do that either.

No, it isn't. And even if it was, there are worse things than theft. But it isn't theft anyway, there was no attempt to defraud or deliberately deprived Tesco of anything. I don't believe for an instant that the virtue signallers on here wouldn't do exactly the same thing in OP's position. They just enjoy pretending to be perfect.

I phoned them in a similar situation when I realised they’d refunded but still delivered and they said there was no mechanism for taking the payment now. Said they used to be able to take payment but no longer the case so it was free

If it will make you feel better, wait about 10 days, then go into the shop and tell the people at the customer service desk what happened. As PP have noted they almost certainly have no way to claw it back, and it would probably take them all day to process it if they could. So now someone from Tesco will have told you to forget about it, which makes it an official windfall. Put £20 in the collecting tin that they sometimes have standing there. Job done.

The thing is OP didn’t want that food, was proactive and cancelled the order in good time, the cancellation was accepted and they still delivered the food. The food she didn’t want. Bad customer service if she then has to pay for the shopping she didn’t need/want and just put up with it even though she now has too much food/not the right food.

But I think laws are.meant to protect us all, from contract law to criminal law.

My point is that a lot of people are wriggling around trying to justify something that is wrong (Tesco are nasty, Tesco make too much money, it's karma, etc).

And yet we would be (rightfully) livid if men went "her skirt was short", "she sh*gged all my mates" "it was only a bit of fun".

I chose an offence that I thought MNers might relate to, and therefore make them think.

It seems some people can hold two opposing views at the same time 😥

I definitely wouldn’t tell Tesco, and I am a law abiding person.. but they made a mistake, there was a confusion (not yours.) If you tell them, in my opinion the person at Tesco will think you are mad!

I would contact the shop immediately because I am not a thief. Use any excuses you want but this is theft. We are not all wallowing in the gutter like you.

This has happened to me 3 times , not cancelled my end but the supermarket made the mistake on 3 large shops.
I wouldn't dream of saying a word...why would you ask on here though...just decide for yourself

By heck, that's a great way to behave.

Refute the argument (we should do what is morally and legally right in all circumstances) rather than just launch into ad hom attacks.

I gave you a heinous example because I thought you might see what equivocating about bending the rules might mean in such circumstances.

But, apparently you don't want to think about the logical extension of finding reasons not to do the right thing at all times.

Good for you. That hasnt happened to me, sadly, but if it ever does I shall take full advantage. I'm not a grovelling Uriah Heep bootlicker like some on here.
