Angela Rayner tax fail

Iwishicouldflyhigh · 03/09/2025 12:56

But it’s ok because she was just badly advised.
I’ll remember that excuse next time I fill in my tax return.

But still confused about one can have 2 main homes?

Her son got a compensation settlement for the damage that caused his disability at birth. Those settlements tend to be in the high six, often seven, figure sums.

The trust used £162,500 from the payout to buy the AR's share of the house which she used for the deposit on her £800,000 house in Hove.

PropertyD · 03/09/2025 20:05

Some posters will excuse almost anything

BIossomtoes · 03/09/2025 20:06

What is this? The Spanish Inquisition? Why is my opinion so important all of a sudden? No I don’t think she has.

Sevillian · 03/09/2025 20:06

PropertyD · 03/09/2025 20:04

Blossom. So presumably she got her son’s compensation to pay for her deposit and buy her out of Ashton.

Oh my God I can’t believe anyone could write this. It’s absolutely abhorrent.

Sevillian · 03/09/2025 20:07

What's your issue? Angela's behaviour re the compensation?

Sevillian · 03/09/2025 20:09

My issue is the absolutely sick way that this has been framed.

PropertyD · 03/09/2025 20:09

Life - this gets worse. So she used some of the payout for her son to buy herself a luxury flat 100’s of miles away from Ashton and says she is co parenting.

She then puts the house in trust to save £££ as well as claiming she only needs to pay standard Stamp Duty.

Sevillian · 03/09/2025 20:09

And I choose my words carefully.

Sevillian · 03/09/2025 20:11

As in when I wrote sick I meant exactly that.

Oh I see.

Well, it's actually what happened. The trust was set up in 2020 when her child received a pay out. The trust fund (£162,500 of it) was used to buy out AR's share of the Ashton house. So the trust fund now owns £162,500 worth of equity in the house instead of the cash. The trust also owned 50% of the house in any event.

You don’t have a clue about the purpose of a trust in the case of a child such as this. Trusts have a good legal purpose in a number of circumstances. They aren’t merely vehicles to avoid tax but perhaps you mix only in such circles.

Her “family home” is in a trust for the benefit of her children (or possibly just for her disabled child, not sure). Her children live there full time, her and her ex alternate who lives there with the children and who stays elsewhere. This makes sense for stability for the kids, especially if that house has been adapted for their disabled kid.

She bought the new flat in Hove.

Her lawyers thought that as she did not actually own the family home it did not count as her residence. More specialist tax advice has now suggested that actually it may count as her residence, so she has asked HMRC to confirm how much SDLT she should pay.

I can’t stand the woman and think she’s a terrible mp, but in all honesty I don’t think she’s done much wrong here, assuming she’s telling the truth about the advice she received then it’s an understandable mistake.

Of course she has. They tax us to death. She is avoiding tax. End of.

PropertyD · 03/09/2025 20:14

If the Trust has paid her £162k then yes. She has used the compensation to fund her share of the new property.

Unless I am misreading something.

A perfectly proper use of the damages for clinical negligence, on both occasions. As any decent clin neg lawyer would advise.

The trust bought out her share of the property in Ashton. The trustees (of which she was one) have a fiduciary duty to act within the trust regulations so presumably can justify the decision was made correctly.

Sevillian · 03/09/2025 20:16

’A pay out’ is also utterly revolting language.

This is shameful.

Your tax and mine are exactly the same as when the Tories were in power. Surely you’re used to it after all these years? Current tax rates are pretty reasonable, the basic rate was 33% when I started work with 9% NI on top.

Yes. I don't think I said anything to the contrary.

BIossomtoes · 03/09/2025 19:56

Christ, can’t you even go away and eat your dinner without being maligned in your absence? If someone turned MN into a full time job without my noticing I want paying.

That looks suspiciously like a personal attack to me @Tryingtokeepgoing. MNHQ doesn’t like those.

Well it wasn’t intend to be, so I apologise if that’s how it came across.

PropertyD · 03/09/2025 20:19

Sevillian. If Johnson had done something like this would you be defending this?

If she really has used the Trust to fund her new £800k flat then she is finished.

No it isn't. It's perfectly usual language. Pay out or compensation.

So you agree with her tweet that tax avoidance causes death but it’s also ok she avoided tax because we are paying the same rate of tax?

Sevillian · 03/09/2025 20:21

Lifeinthepit · 03/09/2025 20:17

Yes. I don't think I said anything to the contrary.

You used the term ‘pay out’ which in the circumstances of negligence resulting in life long disability from birth is quite disgusting. There’s no excuse for using such loaded language when a child has been harmed, none whatsoever. You should be seriously ashamed.

I think that’s a very long way of the mark. No one’s suggesting that are they?
