Well well well.

So now it emerges that Rayner rearranged her property affairs and declared to HMRC that her new flat in Brighton is her main residence and saved £40k on the SDLT bill as a result.

She has then apparently declared to the local councils the complete opposite.

I'm sure slimeball Kier will defend and say it was perfectly legal blah blah blah.

Not to mention she has a grace and favour house funded by tax payers in London as her constituency office is so far away. Yet she 'lives' in Brighton - surely she could just commute that distance like may others do every day.

Surely she has to go.

AFAIK legal advice belongs to the client, not the lawyer. Waiving the confidentiality in the advice is in AR’s hands, I believe.

But, as I said upthread, I don’t like mobs and organised hate campaigns. That’s a left-wing habit we could go without.

The best thing for AR to do would be to keep her counsel on this (there’s a child involved), resign and do some good from the backbenches for the rest of her parliamentary career.

Yes how odd! 'Damned' if she does adhere to rules regarding properties in trust? She obviously is still the legal owner as her ds is under 18. I'm not a lawyer and would have presumed that.

She's cocked up and needs to go.

Yes i had to fill out similar, its very clear that any ownership interest in another property, means 2nd home stamp duty, however small.

However, she says she gave up 25% stake & cashed it in, so i assume this is where the "error" has occurred.

Living in a house, doesn't mean you have an interest in a property for SD purposes.

Whether she can publish the advice is another matter, the firm involved wont want that.

Are you really suggesting a legal firm would make such a mistake?

Or the mistake is made with the information given to the legal firm. We can all make that mistake ...

No problem for me. I think the legal advice will be submitted in evidence to the independent adviser on ministerial standards and they will establish whether any wrongdoing has been committed. Rayner has already said she will pay HMRC the under payment of stamp duty. Pretty much what she said in her interview with Beth Rigby.

HMRC act on "due care" if and its a big IF... Rayner took expert advice, disclosed all facts and acted on the advice, then she has taken due care, if as she has done, notifies HMRC as soon as made aware, they will also take this into consideration.

However, if you re right, she did this deliberately, then she should resign, as an MP too.

I think many business owners, the self-employed and accountants would be surprised to hear about HMRC and this “due care” concept. If you are self-employed or a business owner and you don’t get your taxes right they will come after you with everything they’ve got including fines, the lot.

Of course she has to pay the correct stamp duty! That’s not a flex….

Turning to your predictive powers - did you foresee today’s events too? And do you genuinely believe she will ‘survive’ - in your words.

No I haven’t. I’ve never needed to. Every penny of my taxable income has been dealt with via PAYE but I’ve trusted HMRC to get it right. If I needed to pay a top notch specialist tax firm of lawyers like Shoosmiths for advice I don’t think it would be too much to expect it to be correct. Otherwise why bother?

If Shoosmith's gave her incorrect legal advice, then clearly she will take legal action against them given the serious problems she's been caused . Obviously her taking legal action will require her to have provided them with the correct information and not misled them. So we will soon find out.

Shoosmiths advice to the Trustees, has no bearing on the matter with respect to the adviser on Ministerial standards investigation, because they are investigating Rayner not the Trust. The only relevant advice is that she took personally on the property transaction.

The Land Registry entry makes it very clear that Rayner is a co-owner, and she must have known that. To not do so would fall below the standard of care that a ordinary taxpayer is expected to take.

To hide behind 'trusts are complicated' is a nonsense with respect to her stamp duty obligations. Trust can be complicated, but property ownership, children and trusts is a very simple matter

Zahawi, ex Çhancellor, paid "nearly £5million" to HMRC for his "serious error". If the Chancellor of the Exchequer can't count his millions properly and make serious errors of judgment when juggling his personal finances then so can any of us. You'd hope the Chancellor would manage a little better than that? What hope for the rest of us?

So have just caught up on the thread and it seems that AR's fans have moved on from weaponising the fact that she is a working class woman in order to insinuate that anyone criticising her is a bad person, to weaponising the fact that she has a disabled child.

To anyone who isn't blinded by their loyalty to the Labour party, it's just more grubby hypocrisy from politicians.
