Court didn’t notify me or solicitor of hearing

My non molestation order was dismissed and discharged, my solicitor and I were not notified. Ex attended, but the court made the mistake by not informing me or solicitor of the date of hearing, this is the second time it’s happened which is why the judge just decided to dismiss my application. Anyone been through this?

I’ve changed solicitors, so currently waiting for them to take on my case. I don’t know if I should try and get it reinstated or make a fresh application and explain why we didn’t attend the hearing?

I am no legal expert although I do work in the legal field in the US but I would say it's probably easier to try to explain why you missed the hearing and see if you can extend the existing order versus filing for a new one. Can you contact the clerk of courts and ask them what the process is?

This is dreadful. Sadly, as someone who has daily contact with the court service through work, it really doesn’t surprise me. Over the past couple of years, the admin of the court service has deteriorated really quite badly, and it’s people like you, who really need their help who suffer the most.

Your new solicitor should be able to advise you whether you can get the previous judgment struck out or set aside or whether you will need to begin the process again with a fresh application
