GDPR Breach?

We’ve made a claim on our car insurance policy for an incident where a vehicle hit our car whilst it was parked in a car park.

A witness saw the incident and left their details. I only had a name, phone number & email address for the witness. This was passed on to the insurance. They emailed her and requested her address to send out the forms.

I’ve been really disappointed with the how the insurance have dealt with it so far. Very slow, not responding to emails etc.

Anyway, yesterday I received an email saying we haven’t yet received your witness statement, but in the history chain of the email was the witness saying, I’ve sent it to you via the post, can you confirm you have received it. I replied to the email saying, are you asking me (as the owner) to complete a statement (we have filled out an incident form but not witness statement), I reattached the incident form or did you mean to send this to ‘Jane’ the witness. Anyway they have just replied now, saying please fill out this witness statement asap, when I have opened the form, it is addressed to the witness and includes their name and address!

Would this be a GDPR breech and if so, would you report it?

To add - at the time of the incident, we asked if she was willing to share her address so we could send her some flowers as a thank you for stopping and giving us the details etc and she said no.

A very minor one. They happen all the time due to human error. Let the company know so they can deal. The ICO won’t be very interested.

Better reported to the company in any case because they're the ones who can remedy it, the ICO can't do that.

Thanks, just frustrating that I gave them the chance to realise by replying yesterday, are you asking me or the witness and they have still gone on to send the witness paperwork to me. So twice they have got it wrong (only attached the form with data on once though).

I would wait until it’s resolved. If you’re still annoyed about it then make a complaint!
