so my family member is absolutly panicking to death and i just dont have any word of advice for her as i do not claim dla/benefits etc .. so they had their uc review had to send 4 months of bank statements plus their id and her bank account was clearly over the 6k mark from dec-march but not the extra one she sent from nov-dec , she has a child who is on top rate dla so her dla payments come in at £559 per month she hasent touched the dla payments wich has obv made her back account go over the 6k march so are they going to ask for her to send more bank statements in or can calculate it from the ones they can clearly see were she has gone over 6k without declaring also she's trying to find out why her child's dla money is classed as her capital if she hasent been touching that money for her personal things and needed to save a bit of that dla money up to try and get a room converted for her child as her child shares a room with siblings and this is not acceptable because their disabled child has anger issues and sensory issues were the other children sharing a room get hit and see walls get punched in please has anybody got advise or who can she call for advise thank you for reading

She should make an appointment with Citizens Advice and take all her bank statements in.

If it has only been over 6k for a few months there would not be much to pay back. If she wants her kids DLA to not be classed as her capital then she needs to put that in a savings account in the childs name.

Between 6k and 16k is a sliding scale so she probably won't owe much at all. She should explain in her journal thereason for keeping the DLA payments

She will just have a reduction in her UC. I have £10k and my reduction is £73 a month. She won’t get into trouble, they will just take what they are due from future payments.

on her bank statements it shows she’s under the 6k mark from oct-dec then from dec-march it shows over 6k and she didn’t declare she was saving for a car and she’s worried there going to ask for even more bank statements dating back were she recieved some money from ex partner and may question it

They possibly will ask and she will have to provide them, and an explanation of any money coming in.

Yes it will be classed as hers unless she puts it in an account in his name like a childrens savings account.
