Redundancy protection whilst pregnant or on maternity leave

We're going through restructuring at work. In one instance there's one position with three potential matches. A man and two women, one of whom has recently given birth. The other two have been told she will be matched and they have to apply for leftover positions.

Whilst I'm all for not disadvantaging pregnant women or new mothers on mat leave, these colleagues have asked why should this woman get preferential treatment and they be penalised for someone else's choice to have a child.

I see both sides. She shouldn't be disadvantaged and she is not really in a position to apply competitively whilst dealing with a newborn. But the others are being disadvantaged aren't they.

I'm leaving in September so it doesn't affect me other than listening to it.

Anyone else been in this restructure situation?

Because the restructure wasn't happening when she got pregnant or went on maternity leave and so she needs to be offered the same job that she was in when she returns, or an equivalent.
That is fair for her. Restructure is shit for the other guys but the lady on maternity would have been in exactly the same situation if she had not been on mat leave. It is in place to stop companies deliberately restructuring while someone is on mat leave in order to get rid of them in case they either want to go part time or have another baby or end up having lots of time off because their kid is ill.
