DS works on a 15 hour min contract at Coffee shop- how available does he need to be every weekend ?

DS has been working at a medium coffee shop chain for a month , 15 hour min contract
we have a big family wedding on 25-27 April in London and so he has requested this time off

his boss has said he can’t have it as other people have requested it off and so he needs to sort out swaps with other staff members

But DS he hasn’t even has his schedule for that week yet and he doesn’t know all the staff properly yet

How demanding Can a coffee shop be when DS is on a 15 hour per week contract ?

Zero hours contracts really seem to rely upon goodwill. I don't think it should be down to employees to cover shifts, that is what their (non-zero contract) managers get paid more money to do.

You can ask not to work on particular days in general e.g. every Tuesday if you have college/ another job. Then you are never put on the rota for that day.

Has he passed a probationary period? That gives you more rights. If not, and he just refuses to work that weekend, they may just sack him as there are likely to be plenty of other candidates wanting a job.

It gives you no more rights at all. Maybe psychologically the employer is more committed, but legally you have no more rights the day after passing probation to the day before

Zero hour contract works both ways. He just has to tell them he cannot do that weekend

It’s blunt but I’d say it’s helpful and kind in the ‘radical candour’ mode.

Radical candour is saying what you think, but also giving a damn about the person you are saying it to. Maybe take another look into it.

When I used to work in HR for a retailer we were advised by legal not to expect full flexibility on pt contracts if someone had other commitments such as study, caring etc. It wasn't deemed a reasonable employer expectation. Problem is, before 2 years there's not really anywhere you can go if you get sacked by an unscrupulous employer unless there's a clear discrimination angle, so the employer holds all the cards especially in a tough market

If he can’t get it off and he hands his notice in they may be able to magically grant him the time off. The hiring process is expensive and time consuming and no one likes it.

If he’s remotely competent they’ll likely want to keep him.

When I was younger I worked in a chain pub. I picked up as many shifts as I could and was reliable. In the end I handed my notice in because they wouldn’t give me a week off months after I had requested it because there was a “bank holiday” that week. There wasn’t a bank holiday that week but they just didn’t want me to not be working that week.

They magically approved my request when they realised I was serious about leaving.

Probation means diddly squat. He has no “protection” for 2 years (baring actual discrimination).
