Is this GDPR breach

A complaint has been lodged with my employer about a comment I made on social media (not upheld!). This complaint has come from the head teacher at my son's school and he has identified himself as such (fine) but then goes on to identify me as a parent (which has no relevance to his complaint) am I right in thinking this is a breach of GDPR? It is no business of my employers where my son goes to school.

See I disagree, the headteacher lost enough sleep over a FB post in which she said he was useless. In fact he lost enough sleep to write out a letter of complaint to OPs employer. Who in their right mind does this? Surely you roll your eyes and think nothing more of it.

HT has massively overreacted and made himself look like a right twat if you ask me.

Of course you are right to complain.
You have every right to have an opinion on your childs school and their treatment.

His complaint to your employer is disgraceful and says so much about him.

I think the difference is, OP made snide remarks on social media.

He wrote privately, and no one but OP and the recipient of his email know.

They've both made themselves look like fools. But OP, to a much wider audience. And undoubtedly someone will have recognised her from this thread and will be smiling at her talk of "solicitors and unions".

I agree it will be for others to find amusing in idle chat.

It no doubt professionally compelled him to act.

The headteacher wasn’t complaining to the employer

this HT has made “a LOT of allegations” about the OP and believes in his professional role that the the OP’s employers should know as presumably the allegations would impact job

No the post I made was not "very very bad", has it been then it would have been upheld by my employer when he complained about me, although now you don't seem to think that happened either.

I don't know why your so caught up on me asking my union for advice or a solicitor? Making sure that there was no ramifications on me, given that you and many others on here thought I was at risk of being "sued" it was a sensible precaution to take, no?

he was making a “LOT” of serious allegations against you which he believes in his professional capacity your employer should be made aware of
The post was not what he emailed your employer about
it was the LOT of allegations about you, which you don’t care to share

Again, kindly, people are not struggling to read.

Your posts show absolutely nothing of substance. He thinks you are unfit in your role. That's not a false allegation.

The only thing is he's basically said you've made yourself look a tit on social media before. You say you haven't. No one cares.

Maybe don't attack people on social media in future.

My very first post literally states he complained to my employer about my comment, again one comment - and carried on with other allegations. None true, non upheld. As I have also stated, clearly, has he only written to them and complained about my one comment, I would have laughed it off and left it at that.

He disclosed to my employers where my son is educated. He has no right to do so & there was no reason to include that in his complaint. AGAIN, you might be okay with someone in a position of trust to make false claims about someone, I am not.

he didn’t complain to your employer about your comment op. The reason why HT contacted your employer and the part that the employer is interested in is the “LOT of allegations” about yoi, and serious ones at that.

GDPR is not my thing, but isn't it a breach to spread false information about someone and claim that the records back you up?

Given your rural location and the fact you yourself state that you only have access to one secondary school it's not rocket science for your employer to work out that that is where your child goes to school...so hardly much of a GDPR breach by the head.

As someone that specialises in this I can categorically tell you this is not a breach of GDPR. If you feel so strongly complain to the ICO.

Yes it is a data breach or if not wht not?

The HT knows personal data about the son and the OP as a result of his role as HT.

If he was not HT he may have found it out by other methods but unfortunatly for him he is the HT with data protection obligations.

If he wrote in a personal capacity and disclosed data about a student to a third party.

That is a breach of the childs data.

He contacted the Op's employer and disclosed that the OP had a child and that the child attended "his" school. That is her personal data that he is a data controller for. If she never gave the school permission to contact her employer and inform them about the data they held the HT /school created a data breach

If you genuinely specialise in this area, please could you identify the statutory ground which enabled the HT to disclose to the OP’s employer the personal data relating to her son?

The child is irrelevant. As is the head teacher relationship.

The OP has made comments about a head teacher on social media and reported such to her employer.

It is not difficult to find out whom people are employed by, particularly in the NHS. It is publicly available information. (Facebook/linkedin/NHS website for local trust/local knowledge) Onus would be on OP to prove breach.

This instance would not constitute as a GDPR breach, the ICO I expect would agree with me.

Test my theory and report it..

Why would he think your workplace needed to know what you’d posted on Facebook.
It’s of no relevance to your employer unless you brought your organisation into disrepute which you didn’t as your organisation wasn’t named/involved.
Sounds more like he was trying to get you into trouble I’d be making a complaint to the Governors.
