DLA Tribunal?

I have just applied for a DLA tribunal appeal - does anyone know how long these usually take and how often they’re actually successful?

The government's most recent statistics show that more than half of appeals were successful (around 57%) towards the end of last year.

Citizens' Advice has a useful page with information about the tribunal. They don't mention how long it usually takes to get a hearing date, but the government website says "up to six months".

Hi I applied in January and DWP was supposed to respond by 28th Feb but not heard anything yet. Called appeal’s yesterday and they said it should flag up to someone soon that Dwp haven’t responded and then they will chase it up. I just have to wait for a response.

It can take months and yes I was successful.

We’ve have the same response date of 28/02 and still have heard nothing back! Super frustrating I thought it was isolated but clearly not. Hopefully we hear soon

Do you mean a mandatory reconsideration? I did one last year when my son was awarded low rate dla, I got it pushed up to middle rate

I would go direct to The Tribunal and ask them to issue a direction to the DWP

Tribunal Judges advise that

  1. Attend and
  2. Bring someone with you to hold your hand, prompt you etc you dont need Judge Rinder
My wife & I went for our youngest. Went in ready to give the DWP & hard time

The judge said 'we have looked at the papers & dont understand why the DWP havnt awarded middle rate care & low rate mobility' DWP Rep looked sheepish and said neither do I

Glad yours was sorted out. I called the tribunal and they said I just have to wait for it to be picked up by the team, then they will push the DWP for a response

I went to tribunal for my limited capacity for work. It was very low key, the judge was very helpful and explained everything. Even the DWP representative said they didn't know why it had been refused in the first place!!! Don't give up with it, it might take some time but I hope you get it sorted

I had a tribunal during Covid so it was via the phone. Answered the call, judge confirmed who I was and just said we’ve already decided to award you. They had no clue why it has been declined in the first place.

I applied for DLA for my son on 10 October last year. Was awarded middle rate last month, back dated to the date I applied. So just over 4 months.

Dwp was 2 weeks late with my bundle now theyve responded I'm just waiting for a date for 1st tier tribunal put in for the tribunal 20th Dec

I’m pretty sure I submitted the appeal forms in about August 2023 and the tribunal was in Jan 2024. There was a DWP representative there by video link. They said nothing. I won and as I was leaving, I heard them ask the DWP rep to stay for a minute. I’m hoping they asked why the DWP has wasted everyone’s time.

I’ve not heard nothing waiting since Jan 25. It states about 6 month wait approx.

They did the same to me, but ended up responding in the extension period. You don’t need to do anything as such, you can call the appeal line and let them know. But they carry on going without the DWP input usually, they might submit something a bit later.

Good luck 🤞 and don't be too nervous you got this, statistics show that the majority of tribunals are won and from what I have been told they are quite quick in the actual tribunal, they look at your evidence which has already been supplied to them and then they look at the reasons DWP declined you and make their decision based on the circumstances at the time of your original application, hopefully you will be told on the day of the outcome but not always. Let us know how you get on. I am in London and applied to tribunal in April so looks like I have quite a wait!

It really is ok once you’re in there. One tiny thing I’d advise: where I went (and I’m guessing it may be like that everywhere) they conducted thorough bag searches. Pockets too, I think. I would therefore advise you to clear your bag of unnecessary stuff. My bag was badly in need of a clear out at the time and it was really embarrassing!

As for the hearing, it was a three person panel. They asked me some questions. It felt like they wanted to clarify things/find out more detail, rather than trip me up. I found out there and then that I’d won. The lead up felt stressful, but when I was in there, it felt fine. So try not to worry.

Heyyy. So mine is via video so I won’t physically have to attend. I think I’m more nervous because I’ve been waiting so long I’ve sent over so much evidence and my DS has his EHCP to back up everything I’ve said along with a diagnosis and doctors reports. It’s funny that the DLA have said that according to their criteria he meets 3 out of the 4 points for HRM but fingers crossed we win. The amount of evidence I have sent should be fun to get through. I sent videos and pictures of everything 😂😂
