No safeguarding issues - cafcass - amended letter to court

my ex and I split around 2 years ago, we had 50/50 shared care by mutual agreement (no to and fro, it was the right thing), however he changed career and it meant he needed to leave for work at 3am, because of this he asked me to have our child on the nights a week where he doesn’t work the following (so 2 nights a week)

He is now taking me to court to ask for 50% back, despite not living with the new partner (context here is she is an old friend, so he feels because of that the familiarity is better), I don’t feel this is child first and won’t allow this. Hence why we are now in the court process.

We had the standard safeguarding interview, no concerns as expected and no further involvement - I did though challenge that the letter they issued was not representing our key dispute. I heard nothing, however last week, they sent an additional letter to court with my points - has any one else had this? I feel like some one is listening. I am pro both parents having equal rights, equal rights to spend time with children, I just don’t support his current set up.

my query is, has anyone known of anyone successfully get an updated cafcass recommendation to court letter before? This feels huge to me, but don’t want to get overly positive if this is typical - all I want is the right thing for my child.
