Dear MNs,

First off all i’ll delete this later today so i don’t clog up ‘AIBU’

I’m paying a lovely lady/company to make me a logo for mine and my sons little side line idea (De clutter /Tidy/ Cleans)

Could you help me /advise me on what colour the wording/text should be? Something that stands out but also complements the blue dress and gold hair/crown and broom and doesn’t clash..

I don’t think this grey/silver is right

any advise (only i’ve not got long and it may stay like this )

thank you so much :)

The text should be same gold as broom and hair.

Side note: I’d worry Disney would sue me…

behindthemall · 15/07/2024 09:06

You shouldn’t be using a trademarked image in your logo. It would put me off using you as it’s illegal and screams unprofessional, and it would cast into doubt what other areas of your business there are where you might bend rules or be unprofessional.

Also the logo creator should be helping you with the colours, assuming they’re a graphic designer that should be in their sweet spot.

But maybe a darker gold colour for the text.

CocoBellaSparkle · 15/07/2024 09:08

Hi the company said they couldn’t or wouldn’t make it facially like a Disney character as they could get sued.. so they’ve ended up doing this .. so for them to come up with this .. should it be ok ? as i’m using their services and they’ve got a big platform

And lastly thank you! Gold sounds spot on .. i wish I was ‘tech savvy’ enough to change colours myself as don’t want to keep asking the company to change etc

I would make the text black as it's easy to read.

However worrying about the colour of the text is pointless. You need to scrap this deisgn and start again, as you're stealing a Disney image.

anicecuppateaa · 15/07/2024 09:09

Agree with @LividLoved. I would change the image though. Disney may well sue you and it looks unprofessional to use one of their images. Good luck with the business!

LadyCrumpet · 15/07/2024 09:11

Copyright was my first thought too. They do come after small businesses, I've seen it in my industry.

omegahedron · 15/07/2024 09:12

This is way too similar to Disney. It looks like a market knockoff backpack character. Sorry.

Definitely change it to something that isn't Disney. They are hot on unlicensed usage.

CocoBellaSparkle · 15/07/2024 09:14

ohhh no i’ve paid already .. also I asked her to use an image of me (she’s very popular into making people into cartoons !) so she’s using pics of me and then making into a cartoon with OTT colours /blue dress etc
The company are very well known and popular and are very strict about copy right laws etc!
When i said it looked like a disney princess they said ‘it’s altered .. so while very similar .. cannot get sued as facially not identical ., dress not identical plus no characters identical overall (with this cleaning product in hand) because they’re the experts and i’m not (hence why using their services) I felt confident all is ok (?) nor worrying it’s not …

OP posts:
SoupDragon · 15/07/2024 09:20

I think it's virtually identical to Disney's Sleeping Beauty. They are (allegedly) very hot on suing people if they find out.

Also, if they are "experts" why have they created a logo where the text is difficult to read? It's far too pale.

I would 100% doubt that advice. I think the general rule is that if you can recognise who the character is, it's infringement.

The definition in the UK of a copyright breach is if someone uses all or substantial parts of your work. That looks to me, as a layman, to be very clearly substantial use.

Disney are very very well known for actively seeking out breaches and suing.

On the logo itself, I don't like it. If you're set on the name, I'd have an avatar of yourself. Think about your clients. Are they classy? Paying a premium? Do classy people use services that have cartoon logos? Or are you cheap and cheerful and going for the lower end of the market in which case a cartoon might be appropriate to your market?

And I dont mean that horribly at all to anyone, but if you're paying top prices then I'd do a tasteful logo and try to allude to quality, years of work experience, customer satisfaction and attention to detail And the name should capture the feeling as the customer or their guests walk into the home.

If you are starting out and going cheaper, sell yourself, your personability, use that cartoon and fun font amd have social media in line with that . Good luck!

Luckingfovely · 15/07/2024 09:22

I would reject this image as it is not up to spec.

It is not an original design.

It is highly derivative and sailing close to copyright laws.

Request they start from scratch and present an original design, which is what I assume you have paid for.

Revelatio · 15/07/2024 09:22

It’s almost identical, even down to the dress. I don’t think you’d have a leg to stand on if they sued.

It's far to close, tiny tweaks to the hair and face doesn't stop it from being instantly recognisable as Sleeping Beauty. Regardless of what the company says, I would start again with an original image. You really don't want to take risks when it comes to Disney, they take trademark infringement very seriously.

evtheria · 15/07/2024 09:24

My first thought was that you've used a Disney image, and even after looking at the changes (which are so slight as to be negligible) I think you're taking a big risk here. To be fair, the designer should know this, and you have the right to ask for a redesign.

Also, as a logo it wouldn't really work if you wanted to get it on a t-shirt (eg on breast pocket area) or resized to extra large or extra small... Imagine the costs of printing hundreds of flyers with this image on vs a 1-2 colour logo. Again, these are things you are well within your rights to ask the designer to consider.

Octypuss · 15/07/2024 09:24

As the others have said, you're on dangerous ground here. It's not just the image, it's the link to the words - if you hadn't made a pun on 'sleeping beauty' you might have got away with it. However, the link between the two is too close to the Disney version, and I think it'll cause you issues.

Luckingfovely · 15/07/2024 09:24

Also - this is not a logo, it's an image.

You need something far simpler, less cluttered, and easier to replicate on different mediums.

That is not a font you can use in a logo.

It's appalling quality.

TingeOGinge · 15/07/2024 09:25

You can't use that 🤣🤣

And I'm really sorry, reading that back makes me sound like a cow takng pot shots, I'm absolutely not meaning it that way, im sorry that it's coming across really rude, I'm really not normally, just messaging between tasks and didn't take time to read it. I honestly mean it constructively. Everyone has space in the market, you just need your advertising to reflect that xx

Revelatio · 15/07/2024 09:26

Also, a quick google shows loads of Sweeping Beauty Cleaning Services. I would go for something a bit more original and with no risk of copyright!!

PosingPosture20 · 15/07/2024 09:26

The company are very well known and popular and are very strict about copy right laws etc!

No, they're not.

That design is a massive copyright infringement. And out of them all, Disney are especially known for being litigious. Just google it...there are hundreds of stories of tiny businesses being aggressively threatened with litigation for copyright abuses, by Disney.

I mean, you might be lucky and be fine. And in reality, if you were unlucky you'd never be actually sued, you'd just have a bloody scary letter and would have to change your business name and imagery. But really, it's not a risk I'd want to take.

Werweisswohin · 15/07/2024 09:27

Dark Gold.
I'd worry about that image too, especially along with the name.

TingeOGinge · 15/07/2024 09:28

Disney are constantly sueing small businesses on etsy!

CocoBellaSparkle · 15/07/2024 09:28

Ohh I went with this company as they look /ed amazing and so many companies have not very good images .. like grainy and just screen shot on google images

i didn’t think it would ‘scream low end ‘ and i sent pics of myself (well let company into my socials ) to see lots of my pics to make me an avatar etc!

I don’t know if the last post and paragraph/question on that post is a little jokey put down or a genuine question.. if the latter then of course i don’t want to sell myself ‘cheaply’ etc

i’m trying hard as no longer can do my main career and want and need to earn and want to leave my 2 DS’s with a project as now stage 4 ‘C’ and no treatment and cure and single mum and not even 40 .. thought i was looking professional doing it this way 😔

Werweisswohin · 15/07/2024 09:30

A much simpler logo would work better - are the company trying to make it so detailed so that they can charge you more?

Of course they've sid that, they don't want to start again, plus you're the one at risk of getting sued, not them.

Take a moment to really imagine that letter coming through your door, your house at risk etc. The years of stress and the worry in the pit of your stomach. It's not worth the risk.

And others have said, it's not really a logo that you can print up and replicate. People won't see it without the text and think of your business. If they really won't rework it and you don't want to confront them then I'd prefer to eat the cost. Or ask them if they are happy for you to send the logo to Disney with their name on it and get their opinion directly....

Are you jn the awkward position that this designer is a friend or a friend of a friend?
