Caught on camera, who pays

GoldHold · 25/03/2024 09:45

Person A asked person B for a lift to the station after work. Person B drove through a restricted zone at the station, was caught on camera and has been issued a fine. Person B wants person A to pay. Person A has refused. Who is BU?

ImWearingPantaloons · 25/03/2024 09:46

Person B was in control of the car and made the choice to drive where they did

Flickersy · 25/03/2024 09:46

The driver is the one responsible for paying attention to signs and warnings, and is responsible for driving through a restricted zone. It might be nice for A to pay, but it's Bs responsibility.

Oreosareawful · 25/03/2024 09:47

Person B should pay. Unless Person A said "drive through here, its fine" then person B is the one who wasn't paying attention and drove through a restricted zone.

Person B was in charge of the vehicle, so should pay.

Allfortheloveofabiscuit · 25/03/2024 09:47

Unless person A absolutely insisted that person b drove that way then it is up to the driver

DontBuyANewMumCashmere · 25/03/2024 09:48

Person B!
Unless person A said Drive down there, you'll get a fine but I'll pay it...

It's not Person A's responsibility to make Person B drive correctly.

purpleme12 · 25/03/2024 09:49

The person driving should always pay.
I guess if the other person was feeling really kind they could offer to pay half but I would never think they should.
Non drivers don't know road rules

FiveShelties · 25/03/2024 09:49

Does not matter if passenger insisted, the fine is down to the driver.

What is that saying - no good deed goes unpunished?

Gravelgraze · 25/03/2024 09:50

I think person A should offer to pay half the fine. Of course they weren’t in control of the car but it would be the decent thing to do.

p1ppyL0ngstocking · 25/03/2024 09:52

It's for the driver to pay, although if I was A I'd be offering half minimum.

Equally as B, I would brush off every future request for a lift from A with a "no thanks, last time I gave you a lift it cost me £50".

A can't expect to be driven round by other for free, it takes time, energy and a lot of money to run a car. A should be prepared to get a taxi in future.

Hoppinggreen · 25/03/2024 09:54

Driver - unless the passenger insisted it was ok or similar.
Might be nice to offer a contribution though unless they had no idea (doent drive or similar)

Haydenn · 25/03/2024 09:55

Unless A insisted on that route it is the drivers responsibility. I probably wouldn’t ever give A a lift again though!

BeyondMyWits · 25/03/2024 09:56

If A doesn't offer to pay at least half, good luck getting a lift ever again. Yes, B is the driver in charge of the vehicle, but wouldn't be in this position if they weren't doing a favour (A asked for a lift), so common decency would dictate an offer to pay.

TidyDancer · 25/03/2024 09:56

The driver should pay. If I was the passenger in this scenario I would probably offer to pay half since they were doing me a favour but I don't think you can expect a non-driver to know the rules of the road and even if the passenger was usually a driver, they probably weren't paying as close attention as they usually would be if they were behind the wheel.

I presume you're the passenger OP?

Magnastorm · 25/03/2024 09:57

B.

The driver controls where the car goes.

wombleberry · 25/03/2024 09:58

The driver should pay, but as a gesture of goodwill the passenger should probably offer half. Frustrating for both parties, but sometimes shit happens.

AdoraBell · 25/03/2024 10:01

The driver is responsible. If this is a zone like ULEZ then the passenger should have said something when they asked for the lift. But ultimately the driver is in charge of the car so is responsible.

If you are the driver OP then I sympathise. My DH get caught out when visiting London.

GoldHold · 25/03/2024 11:20

I'm neither, but this has confirmed my opinion. The driver should pay as they are responsible, however it would be a good gesture for the passenger to offer to pay half.

My recent good deed earned me a fine. I delivered a couple of spare sleeping bags to the homeless shelter in an unfamiliar part of the city. It was dark and the rain was lashing down. Realised a split second too late that I’d driven into a street restricted to buses and taxis. I was so annoyed at myself.

KimberleyClark · 25/03/2024 12:24

Person B, though if I was person A I’d offer to pay half.

Marblessolveeverything · 25/03/2024 12:28

Why on earth would a passenger be responsible for a drivers actions?

In this case, because the journey was purely for the passenger's benefit.

While of course it's legally the driver's responsibility, I'd feel morally obliged not to leave someone out of pocket if they made this sort of mistake while doing me a favour.

DaBlackCatsAreDaBestCats · 25/03/2024 12:34

The driver

IDontLoveTheWayYouLie · 25/03/2024 12:36

Unless person A managed to take over the driving last minute to get the ticket then person B should pay.

Why should they pay half? I don't think there is any moral obligation for person A to pay for person B's bad driving.

I mean if someone crashed a car while giving you a lift you wouldn't expect to pay half towards the repair.

NavyKoala · 25/03/2024 12:45

Driver pays but doesn't do lifts to the station again.
