Adult Ds is being discharged from hospital on a section 3 for 28 days. Then they said to may make it longer.Aibu to think an inpatient section shouldn’t be used in the community.

It’s definitely not a community orde as the consultant has said he won’t be on one and doesn’t want to put him on one.

we asked for a community treatment but he’s basically indirectly doing it but won’t do it formally.

Hmmm…that sounds a bit bizarre from what I understand of the mental health act. I would be getting some expert advice!

Are they suggesting it is long term leave? Sounds like a challenging time for you and your DS. Hope things improve

I don't think anyone here can really say whether it's reasonable or not; even if we were mental health professionals, we wouldn't have met your son or seen his medical history. Maybe you could get some impartial advice from an organisation like Mind, or somewhere like that? I understand it must all be incredibly worrying for you.

Reading more into it, section 17 can give leave like this when you are on a section 3. But if things are unclear Mind is an excellent source of support and has a legal advice line.

He's still on a section 3 he's just having section 17 leave, this is very common when somebody is on a section 3 and their mental states is improving. ,its to build a patient to get ready for discharge , if there are any changes whilst he's in leave or his mental health deteriorate, s he can go back to hospital
Have you had a leaflet explaining his rights under the section ?
If not ask for one
