THREE PARKING TICKETS

We have a blue badge, and have signed it up with the NCP parking company. It's logged in with our number plate- but the one time we come back late at night with a small child, the blue badge holder was accidentally left closed- but you can see its a disability badge from the big disabled logo on the front. It's a station carpark about 10 minutes from our house as our road refuses to give council tenants parking, only private tenants.. fair enough.

But now we owe 300 pounds all because it was left closed for one day, despite us already sending images, signing up our badge and car over a month before hand.

The other ticket comes from the hospital (NHS) where we parked in a blue badge spot but the camera automatically couldn't see the badge... so we owe another 100 pounds.
We don't feel safe leaving the car ANYWHERE now.

AIBU to appeal this and possibly take it to court? Everyone in the car, child included- is disabled.

When was the 3rd ticket? I'd appeal the hospital one- do they have a photo of your car? The NCP one I suspect you've got no chance as you didn't display the badge correctly :(

Whiteday · 21/11/2023 19:22

The first one, your own fault, the second one not.

But where did the third come from?

SerenaBeans · 21/11/2023 19:23

@LoveTheDarts 2 where the NCP, saying due to it being 24 hours we have to be charged twice-

But the thing is, we are signed up with them and they know we have a badge and they have an image of it from where we signed up with them initially. I dont think it's fair to be charged so much for a simple mistake- especially when you can see the badge in the car, just not fully open

Are you sure you don't get a discount for paying promptly?

SerenaBeans · 21/11/2023 19:24

@Whiteday sorry forgot to mention that two where from the NCP claiming twice within a 24 hour period.

I hope they realise our badge and plate are on their system :[ we can't afford the tickets as we just moved house and it sapped our funds entirely

OP posts:
SerenaBeans · 21/11/2023 19:26

@Whiteday it's my DHs car, and from what I've seen on the letters I don't think so. I'll ask him to have a look.

Pretty sure the rules always state must be clearly on display at which point you’ve just sadly fallen foul of the rules.

There are many people who purposely don’t open the folder because they don’t actually have a badge. Also, the badge is for a named person, who may or may not have been in the car you registered. They could have been out with a friend in their friend’s car using the badge and you could have just been chancing it. That’s likely why you’ve been fined. And because you went over 24 hours you’ve been fined for each day.

SerenaBeans · 21/11/2023 19:29

@Soontobe60

Our badge, and licence plate are registered with the parking lot. And we park there every single day.. the one time it's shut was a very honest mistake.

Do you think we have a chance?

OP posts:
SerenaBeans · 21/11/2023 19:30

@OhmygodDont
I'm hoping we can appeal.. it was an honest mistake and we are on their system and acknowledged as registered disabled.

OP posts:
MatildaTheCat · 21/11/2023 19:30

Have you appealed? I have grovelled and appealed in a similar situation and was let off ‘just this once’.

The hospital I attend has a system whereby you have to register your car number plate with the car park attendant so the automatic cameras will exclude you from payment- have you checked their system?

I do empathise- I’ve had more tickets with a BB than without but it has always been due to my own mistakes.

I’ve no idea! But I do know that disabled parking bays at train stations are for people who need to use the train.

SerenaBeans · 21/11/2023 19:31

@MatildaTheCat
No signs in the hospital other than "Pay and Display your ticket- unless you own a BB." And we displayed our badge.

I hope we are let off, or if it was a mistake they realise it.

OP posts:
SerenaBeans · 21/11/2023 19:33

@Soontobe60 it's used by all the council residents, and aslong as you pay or register your badge they don't really care what you use it for (we did ask initially, and checked the website)

There is no where to park within a 15 minute walk except that lot. Two people beside us are there every single day too, and some people on the upper levels are our neighbours

Where do disabled travellers park then?

SerenaBeans · 21/11/2023 19:37

@bleughgreen
That's why I'm wondering if it's reasonable for us to appeal. Because our licence and blue badge are logged into the parking lot and the company is aware of our badge and have a picture of it from when we signed up a while ago. And it's an appointed mobility vehicle, but I don't think that makes a difference :,)

It was late at night and an honest mistake. You can see it, it's just cracked open (the leather case doesn't let it shut entirely)

Either way I feel so stupid and horrible for DH who owns the car.

OP posts:
SerenaBeans · 21/11/2023 19:38

@Soontobe60 there's about 50 disabled bays. The car park only gets used by about ten people only three of which are disabled including us. So.. probably in the other spots? The car park is one of three used by a small station.

OP posts:
FiveShelties · 21/11/2023 19:39

Was the badge properly displayed at the hospital?

SerenaBeans · 21/11/2023 19:40

@FiveShelties

Yes. Entirely open, the auto camera just doesn't catch it

OP posts:
Billybobranaway · 21/11/2023 19:40

It does not really matter if you are registered with the company as if the person the badge belongs to is not with you, it can not be used. So the parking company are in the right become your badge was not displayed. So even though you are registered with them it does not mean each time you park you are eligible for the disabled bay ect.

SerenaBeans · 21/11/2023 19:42

@Billybobranaway
The driver is the owner of the badge- no one else can drive the car (I'm too scared to learn).

It was just accidently left closed. Just wondering if we have a chance to appeal

OP posts:
FiveShelties · 21/11/2023 19:43

I would definitely appeal that one then. Not sure on what grounds you could appeal the other two though.

SerenaBeans · 21/11/2023 19:43

@FiveShelties
DH wants to try appeal it all anyway, but otherwise we will have to enter some form of scheme to pay it off bit by bit

Squirrelsnut · 21/11/2023 19:45

I was recently let off a parking ticket, much to my surprise. Give it a try.
