Have I misinterpreted our parenting agreement?

Missdusk91 · 07/11/2023 14:51

Below is the Money section of our Cafcass parenting agreement that we both agreed to. How would you inerpret this? As would pay half extra curricular expenses or child maintenance whichever is greater or as would pay Child Maintenance amount and then would also pay half of extra curricular stuff.
I am being told by ex I have mucked up and thats on me.

OP posts:

Pay CM + discuss and agree payment for extra curricular activities

Orangey25 · 07/11/2023 14:56

Yes as above. CM but extra curricular to be discussed and split equally if possible

museumum · 07/11/2023 14:57

Items 2 and 3 read as complete Ely separate to me. There’s no “or” anywhere and no ref to “whichever is greater”. It’s both.

SgtJuneAckland · 07/11/2023 14:58

To pay CM and then in addition to share the costs of extra curricular where possible

This.

Laurdo · 07/11/2023 15:02

Why is CM being paid if childcare is shared equally?

PabloandGustheGreySquirrels · 07/11/2023 15:04

In addition to maintenance and split between you both

YaWeeFurryBastard · 07/11/2023 15:06

Child maintenance plus half activities (but these would have to be agreed). I’d suggest getting the photo removed though as can see all three names!

MrsCarson · 07/11/2023 15:14

It's two separated things on there 2. pay child maintenance 3. Discuss and split extracurricular costs for Childs benefit

SMTWTFS · 07/11/2023 15:14

Child maintenance to be paid and then share activities. I'd remove this post I can clearly read your name, your ex's name and your sons name.

SMTWTFS · 07/11/2023 15:15

But why is CM being paid when care is shared equally. I dont think any CM should be paid, just activities are shared cost.

Honeysuckle16 · 07/11/2023 15:16

The meaning is clear, as outlined by all posts. Presumably your ex agreed to this wording when the agreement was made so him saying you’re responsible for any difference of opinion is pretty bad.

HollaHolla · 07/11/2023 15:18

I think I'd read it the same as others.
But, like a PP pointed out, I can clearly see all three names of the people involved. You might want to report/remove it.

CaineRaine · 07/11/2023 15:18

Yep extra curricular costs are separate to CM payments. So CM is paid at whatever amount is due. Then extra curricular costs are calculated and split between you. However, the “where possible” gives wriggle room - who decides what’s possible?

mathanxiety · 07/11/2023 15:20

Pay CM and discuss and allocate the extra curricular costs which are a completely separate thing.

camberlian · 07/11/2023 15:28

2 separate things but the words 'of benefit to' and 'where possible' are too vague. If one decides there is no benefit or not possible surely it can't be enforced?

Bobbotgegrinch · 07/11/2023 15:56

I'd ask Mumsnet to take your picture down @Missdusk91 if you want to keep the names private. I can see you, your exs and you childs name very easily

HaplessRhombus · 07/11/2023 17:39

Not sure why people are questioning why it mentions child maintenance. It says "pay child maintenance in line with CMS guidelines". If care is genuinely split 50-50 then CMS guidelines would suggest £0 so that's what he would pay. It's presumably just in there to cover any change in circumstances (and presumably they specified one parent here because there's a relevant circumstances why they occasionally might not have 50-50).

And yep, I can see all the name here so you probably want to edit.

Lougle · 07/11/2023 17:49

The wording gives your ex the right to pay £0 CM if he genuinely has your DS for half the time.

Extra curricular activities as agreed between you. But only if you can agree on whether it benefits your DS.

GlasgowGal82 · 07/11/2023 18:11

You've not done a very good job at obscuring the names in the OP. I can still read the child's name and the parent receiving CM's name. If you want to protect your privacy you need to delete or re-edit.

ccvv · 07/11/2023 18:14

I can read the names in the picture.

It's pay cm and extra curriculars to be agreed. Which means that clause is useless and can't be enforced in reality.

margotrose · 07/11/2023 18:16

You can see your son's name OP, just FYI.

I've read it as "Child maintenance is to be paid and anything else is to be discussed and split evenly where possible".

Tinkerbyebye · 07/11/2023 18:24

You get child maintenance e of £x and extra curricular activities to be discussed and split when possible
