Am I right or wrong?

My work shift is 8-4.30, I have holiday booked 1-4.30, if I worked a full day I have a 30 minute unpaid lunch break. Work are telling me I won't get a lunch break. But surely if my holiday hours are being used for a half day I'm still entitled to my unpaid time? I don't want to argue with a manager about it if I'm wrong lol! Help me out

So you do eight and a half hours in a full day? I'd leave at 12.15pm so you've done four and a quarter

Chestnutz · 02/10/2023 11:51

If your lunch half hour is unpaid - then you’re working 2 x 4hr shifts.
1 shift is 4 hours so you can be done by 12pm?

flipent · 02/10/2023 11:51

This ^^

TeaKitten · 02/10/2023 11:52

You don’t need a break on that shift, but your half day starts at 12.15

111111111a · 02/10/2023 11:52

Sorry yes you do eight hours so I'd work 8am to midday then leave

TeaKitten · 02/10/2023 11:52

Or 12 actually

turtle8919 · 02/10/2023 11:54

Yes! I usually work 8-4.30 with a 30 minute unpaid lunch. Work are telling me I don't get my 30 minute unpaid lunch as not working over 6 hours in one block now. But surely I'm now giving them 30 minutes of my time?

So you work 8 hours, and have half an hour in the middle for lunch. which is not paid?

So yes, you should work from 8-12 and then you can leave. Your half day leave is from 12:30-1630

turtle8919 · 02/10/2023 11:55

That's what I think too, but they are telling me I need to work until 1?

If you leave at 1 it’s an hour longer than your shift should be. So you should finish at 12. They are right that you aren’t entitled to a break though.

I do this when I book a half day - work 9-5 with an hour unpaid. so book 1-5 as holiday but leave at 12 as my hour lunch.

In your situation I'd leave at 12:30. 12:30 - 1 is your 30 mins and the remainder of the day as annual leave.

That's not right - means you're only working 3 hours when half a day for you should be 3.5 hours.
8 hours at work, - 1 hour break = 7 hours/2 = 3.5hours you should leave at 12:30 on a half day.

OP you should be leaving at 12pm.

Cece92 · 02/10/2023 12:03

I usually work 9 hours and get 30 minutes unpaid. My shift is 9/6 so if I book a half day I'd finish at 1 because my lunch is unpaid. X

budgiegirl · 02/10/2023 12:04

They are right in as much as you won't get a lunch break, as your shift that day isn't long enough.

But if you usually work 8 paid hours a day, and you are taking 3 1/2 hours of holiday, then you should be working 4 1/2 hours that day. Anything over this should be paid.

Otherwise, take a full half day (4 hours) and leave at 12pm after your first 4 hours.

QforCucumber · 02/10/2023 12:07

@flipent our annual leave is given in hours not days so it doesn't really make a difference - if it were a half day/number of days allocation then yes I agree I'd work 3.5 hours for a 7 hour day, working 9-12:30, however if I'm booking 1-5 off then that's 4 hours of my allowance, not 3.5.

I am able to book 3-5 as annual leave if I want, and leave at 2 if I work 9-2. The allowance being in hours is great for things like that.

flipent · 02/10/2023 12:09

@QforCucumber my mistake - I've only ever worked places where a half day is just that.
If you're taking specific hours then that does change the scenario.

YeahNoYeah · 02/10/2023 13:18

You definitely don't work until 1pm if you're taking half a days leave. Have you booked half a days leave or 3.5 hours leave?

So they are classing:
8am til 1pm (5 hours)
1pm til 4:30pm (3.5 hours)
As both half days? That's ridiculous!

It's 8am til 12pm (4 hours)
12 til 12:30 lunch (30 mins)
12:30 to 4:30 (4 hours)

Therefore booking the afternoon off means you leave at 12pm

BarbaraofSeville · 02/10/2023 13:23

What @YeahNoYeah said.

Or you could look at it this way. You'll have a 'spare' long half day of AL, so you should use this to take the morning off at some point, and not start work until 1.30 pm to even things out.

If they won't let you do that, it proves that you are right and you should leave at 12 when taking the afternoon off.

SBHon · 02/10/2023 13:36

I hate work places like this, so petty. Having time off is supposed to be nice but grumbling about 15-30mins adds unnecessary stress.

MrsPinkCock · 02/10/2023 13:53

It’s not clear from your post whether you booked 3.5 hours holiday or half a day? The two could be quite different!

turtle8919 · 02/10/2023 14:59

So! Turns out after they looked into it! I am right! If I hadn't taken a lunch I would have been working 8.5 hours (including my holiday) and only then paid for 8
