Started a new part time job 3 weeks ago. Great hours which suit me in a tiny family run business.
However...
No lying time and paid weekly, but I've still not had any wages, should get them soon, apparently the accountant is a bit slow.
Entitled to a break, but we don't get one.
The owner doesn't give contracts.
Wage slips (not that I've had one yet) are infrequent, sometimes a few months late.
And absolute sweatshop, literally can go all shift without a pee.
Allowed to bring in a bottle of water, no snack, no cuppa, nothing.
I'm absolutely fucked after each shift, but the other 2 members of staff accept it as their lot and say that's just how it is and I should be glad of the job.
Should I suck it up and become indoctrinated into their way of thinking, or as I really want to do, spin on my heel after telling them to shove it? Which would be soooo easy, especially as I've no contract.

Fuck all of that: the bits that aren't illegal (most of them) are, at best, immoral.

Get out and then get on the phone to HMRC. 'A week in hand / lying time' in 2023, FFS, does he think you came down with the last shower of rain?

He doesn't do wages a week in hand. I was told that like it was a positive, which makes 3 weeks with no pay all the harder to swallow.

I think lying time is just another term for 'paid in arrears' isn't it? So pretty normal. Not, however, normal to be paid a week in arrears and have had no money for 3 weeks!!

I'd definitely speak to job centre OP and ask them (at the very least!) how long they expect you to work without pay before you can leave the job without sanctions.

They are breaking a few laws, and there are so many things wrong here, that it's hard to know where to start.

No I should get paid from my first shift. No lying time/week in hand. I have worked 12 shifts in three weeks an have up to now received sweet fuck all.

Then add them to the list of people you report his illegal work practices to.

I reckon this is a genuine reason for leaving a job. Did the JobCentre recommend it or help you get it?

It was on the board of the job centre. I asked my job coach about it, she looked it up on her computer and gave me a post it note with the phone number to apply on. I still have that bastard post it note stuck to the fridge. Wish I hadn't bothered my shirt.

You can show you had good reason both that you have not been paid and it against health and safety you should not be sanctioned if you leave your job for that.

They are supposed to pay you weekly and they have failed to do so? Do you have a record anywhere where it said it was weekly pay eg the job advert? You don’t need a written contract to have a contract of employment it’s just it’s a bit harder to prove the terms.

Its potentially a breach of the Employment Rights Act 1996 as an Unlawful deduction of wages.

You are also entitled to breaks. I would tell the job centre the company wasn’t complying with Employment law.

I work in the job centre and if this is a job we had advertised then one of our employer advisers would be speaking to your employer to confirm what you have said and to advise them that what they ass doing is illegal and to try to help you get your wages asap.

Print off the working time rules.

After your 6 hours up and walk out and say "I'm taking my 20 minutes break now."

If he says anything just ask him if he's actually telling you you aren't entitled to have legal working conditions?

How do employers like these manage to brainwash their employees ?

A family member worked somewhere that ended up like this - wages paid intermittently, as and when money was around it seemed - she kept working hoping to get her wages caught up but left in the end. This was many years ago and she still gets letters from nest about her employer’s non payment of pension. I believe they continued on the same in other places they subsequently ran.

You should go back to your job coach and explain all you have put here to help avoid sanctions, but you will probably find you have been working for free unless some money rolls in for them, so I wouldn’t stay longer than necessary.

Such a shame for you though, hopefully next job will be better.

I think it would be better to get fired for trying to take your break when you're not allowed to than to quit and get in trouble off of UC. Or just get another job and then you have a "good reason" for leaving. Make sure you get your holiday pay though!
